The original approved plan for the Chloe's Way Subdivision consisted of 25 lots and among other conditions a no cut buffer. It is our understanding that the no cut buffer was implemented to maintain the total site disturbance at less than 5 acres. By staying below 5 acres of disturbance a Full SWPPP with post storm water controls was not required . These plans, specifically portions of the no-cut buffer, were amended in 2018 in response to a concern about potential over clearing of the Phase I lots. The no cut buffer was amended to allow for the planting of naturalized areas to serve as a buffer between adjacent areas. At some point after the amended plans were approved, it was determined that a full SWPPP with post stormwater controls was needed and subsequently obtained . Now with the implantation of a Full SWPPP there is no need to maintain any no-cut buffers however with this application Mr Ethier is proposing to keep a 10-foot buffer along the remaining lots to be built. Furthermore, Mr. Ethier has been working closely with the city throughout this project's development and just recently gone above and beyond by giving the city a sewer easement for a forcemain . By doing so the city has saved approximately $ 1 million in infrastructure costs. He has also helped with pedestrian connectivity by granting a sidewalk easement through Lot 18. Providing these easements has made the remaining rear yards restricted with the current 25-foot no-cut buffer. As a result of obtaining a full SWPPP and the additional easements provided to the City, he is asking to be able to reduce the no-cut buffer from 25 feet to 10 feet. Also, since a full SWPPP has been obtained and a no cut is no longer necessary anyway, Mr. Ethier believes that this adjustment is a very minimal request.
