Comments We are writing regarding a petition to the Zoning Board of
Appeals regarding a variance for 31-33 Marion Avenue.
The letter states that this request is for a variance "to permit
demolition of existing garage, mobile station, car wash, and to
construct a Convenience store, gasoline canopy, car wash and
rental space within the Tourist Related Business (TRB) zone."
We object to this proposal because Stewart's Corp is
expanding the footprint of this project into a residential lot in
order to include a large retail rental (3190 sq ft) which is
intended to be a liquor store, and a car wash. So, this project is
NOT fully enclosed in the TRB district. The car wash and
parking for the rental business clearly violate the existing
zoning and comprehensive plan by expanding commercial
business into a residential lot. We object to any expansion of
commercial business into the residential zone. We would not
object to Stewart's keeping a project within the boundaries of
the TRB district where the original footprint is located. We, as
homeowners also filed a complaint early last year regarding
Stewart's parking U-Haul rental trucks on the residential
property and previously filed a complaint (2020) about the
service station using that residential lot for parking of vehicles
being worked on at the service station. We did not hear back on
those written complaints. That was a clear violation of the
zoning by allowing Stewart's to conduct commercial business
on that residential property.
