RE: Advisory Opinion to the ZBA
ZBA#202 I I 217—90 Catherine Street
Per your request to coordinate SEQRA review and seek an advisory opinion,the Planning Board
considered the following application at our March 10, 2022 meeting:
ZBAAPP.#202 I 1217 90 CATHERINE AREA VARIANCE, 90 Catherine St., coordinated SEQRA review
and advisory opinion to the ZBA for area variances associated with a proposed two-lot subdivision in
the Urban Residential—2 (UR-2) district.
Following discussion and evaluation,the Planning Board passed the following motions by a 7-0 vote(In
favor:Torpey, Horton, Fabozzi, Mayo, Doty, Marshall, Pingel):
� Accepted lead agency status, evaluated part 2 of the short EAF, and issued a Negative SEQRA
Declaration.
• Issued an unfavorable advisory opinion on the requested area variance from the minimum lot
requirements in the UR-2 district. If granted,the variance would result in two substandard lots
in both minimum lot width and minimum lot area in UR-2.
In addition, the maximum density in Residential Neighborhood-2 (RN-2) in the Comprehensive
Plan is 7 units/acre. If granted,the variance would exceed the maximum density called out in
the Comprehensive Plan and would result in 3 units on 10,675 sq. ft. or 12 units/acre.
