NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION
#20220 I 72
74 MITCHELL STREET
SARATOGA SPRINGS, NY I 2866
Involving the premises with tax parcel #I 66.70-I-I 7, in the City of Saratoga Springs, on an application for a
permanent special use permit for a private/civic club within the Urban Residential—3 (UR-3) District.
In accordance with SEQRA regulations 6NYCRR Part 617 and after review of the SEQRA short Environmental
Assessment Form Part I, and identification that no new or different impacts would occur with this project that
were not previously considered, made a motion to reaffirm the Negative SEQRA Declaration that was issued on
October 28, 202 I;
Having properly noticed and conducted a public hearing on March 24, 2022 as required on the proposed use;
And, upon evaluation of the application based on the City's enumerated criteria to ensure that the proposed
use(s)will not adversely affect surrounding properties and community character;
And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7.I "Special
Use Permit",the Planning Board issues the following decision on March 24, 2022 (passed 7-0—in favor:
Torpey, Horton, Fabozzi, Mayo, Marshall, Pingel, McTygue):
C� Issued a permanent special use permit for a private/civic club defined in the zoning ordinance as "a social,
fraternal, religious, or service organization not primarily operated for profit nor rendering a service that is
customarily carried on as a business".
The lot will be commonly-owned and maintained by seven adjacent residential properties — (5 fronting on Union
Ave. and 2 fronting on Mitchell St. as shown on the`Existing Adjacent Parcels' plan). Ownership, management and
maintenance of the lot will be specified within restrictive covenants and deeds within the HOA documents.
The use is permitted per the submitted `special use permit site plan' dated 03/02/2022 including recreational
amenity area consisting of approximately 2,400 sq. ft. (footprint) clubhouse and pool area for the exclusive use of
the HOA members and their guests.
Conditions:
I. Club membership shall be a maximum of I 2 members and club usage limited to club members and their
guests.
2. Hours of operation for the pool area shall be sunrise to I I pm daily.

3. Club activities shall comply with the City's Noise Ordinance, Ch. I 48.
4. Maintenance of a 6 ft.to 8 ft. area along the rear property line of the club lot (adjacent to Snyder Lane)to
be used as a landing or pull-over area.
5. Minimum 5 ft. area along the rear of the Union Ave. properties to be maintained to provide pedestrian
access from these properties along the alley to the club lot.
6. On-site lighting shall not spill onto adjacent properties and shall be further discussed during site plan review.
7. Site plan review and approval required to implement the SUP.
Note: this approval shall expire I 8 months from the issuance date unless all conditions have been complied
with and actual work begun.
