First to modify and expand her stated address and my address. We live at 121 Nelson Avenue, Saratoga Springs, NY and, though close to the case in question, we do not feel we will be impacted by whatever your decision. We are not NIMBYS. To be very clear our concern is not as residents of Nelson Ave but as very long -term Saratogians who have fought for 50 years to protect and improve this place we love. Thus we speak with malice or anger toward none. Mr. Waite claims the seller of the property under discussion deceived him misrepresenting the property as a three family. Mr. Waite tells us he purchased the property using the money he saved for retirement. Because he cannot legally use the property as a three-family his retirement is threatened. Mr. Waite apparently did no due diligence prior to purchasing the property. The property was put on the market by the previous owner in 2010 as as a sin� /c�e family home with a mother-in-law apartment for$859,000. (See A Listing) Mr. Waite purchased the property in 2013 for$801,500. It seems unlikely that the prior owner went to the trouble and expense of converting the one-family into a three-family only to sell it three years later for$57,500 less than they were asking for a one-family. In response to this question from Richard Tiersch, Assistant Building and Construction Inspector, Mr Waite stated on 1 1/71201 9, "The three car garage has a bedroom on the second floor and a separate egress entrance. Unit is currently not rented, but it rents out in the summer. The renovated barn has a kitchen and a separate egress entrance. Uses (sic) this space as an `in-law' suite. Not currently rented, but rents it out during the summer ." (See B 85 Nelson Ave. 3 Family House (Code Violation)paragraph 4) Is it conceivable Mr. Waite saw this as a three family? The prior owner has a history of seeking appropriate variances and obtaining building permits and Certificates of Occupancy for renovations. Mr. Tiersch, in document B paragraph 5 states, "This property was Denied a Variance for a `Temporary Accessory Dwelling' on 4/10/2002. There have been NO new permits to add additional bedrooms and kitchens or egress access for this property." Mr. Waite could undoubtedly recoup his initial investment by selling this property as a one-family with a mother-in-law apartment. I respectfully suggest there is no basis for granting this variance.
