In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified this action as an Unlisted Action, Coordinated Review, and acting as Lead Agency issued a Negative SEQRA Declaration on October 4, 20 I 8. Having properly noticed and conducted a public hearing on January I 3, 2022 as required; and closed on March I 0, 2022 on the proposed uses; And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the proposed use will not adversely affect surrounding properties and community character; And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7.I "Special Use Permit",the Planning Board issues the following decision on March I 0, 2022 (passed 5-2 in favor:Ayes - Torpey, Horton, Doty, Marshall, Pingel: Nays— Fabozzi, Mayo): C�Approve I-�rear temporar-�r special use permit for the existin�three �3� warehouse tenants onl�r within the I 2,500 sq. ft. buildin� at the rear of the proper-t�r and identified as follows: - H att i e's Restau rant - Saratoga Tea& Honey - Antique dealer(unknown business name)—storage, maintenance and resale of vehicles and/or vehicle parts. The Board finds that while the requested uses are not compatible with the intent of T-4 Urban Neighborhood the applicant/owner has discontinued some non-conforming uses(golf driving range,office, boat storage)and has stated he is actively trying to sell the property. Any future development project would require special use permit and site plan review. The Applicant stated that he had recently received bids to purchase the property and the Planning Board is very concerned for the existing tenants. The I-year temporary special use permit does not allow new or additional uses to begin at the property. Instead, it is intended to provide sufficient time for the current tenants to secure other business accommodations. Page I of 2 The temporary special use permit is for one year from date of approval (Mar. 10, 2022). The above existing warehouse use tenants may continue for one year after which time the special use permit shall automatically terminate and the use shall be permanently discontinued (Mar. 10, 2023). The temporary permit may not be Irenewed or extended. Conditions: If any of the existing 3 tenants (identified above) vacate the building within the I-yr. of the temporary SUP they shall not be replaced with any other tenant and the space that was occupied shall remain vacant. Improvements along the Weibel Ave. frontage including new sidewalk, streetlight, two street trees and one fire hydrant shall be installed as shown on the site plan submitted in furtherance of the application and as requested by the Fire Dept. The applicant is required to: Deliver a letter of credit or cash escrow in the amount approved by DPW to the City per Article 7.2.I 5 of the Zoning Ordinance.
