IN THE MATTER OF THE APPEAL OF

In the matter of the appeal from the Building Inspector's determination involving a parcel at 116 State
Street,in the City of Saratoga Springs,New York,being Tax Parcel 165.36-1-21 on the assessment map
of said City. The applicant having applied for an area variance under the Zoning Ordinance of said City
to permit finished space in an accessory structure in the UR-1 District, and public notice having been
duly given of a hearing on said application held on the 28th day of February 2022 through the 14th day
of March 2022.
In consideration of the balance between benefit to the applicant with detriment to the health, safety, and
welfare of the community, I move that the following area variance for the following amount of relief:

As per the submitted plans,be approved as per this Board's consideration of the following factors:
]. The applicant has demonstrated this bene�t cannot be achieved by other means feasible to the
applicant. The applicant wants to construct a single-story detached garage for vehicles, a place for
storage, and to support outside activities. As noted by the applicant, the proposed garage will be a
showcase for their vehicles during entertaining and this would require the space to be finished.
2. The applicant has demonstrated that granting this variance will not create an undesirable change in
the neighborhood character or detriment to nearby properties. The applicant notes the accessory
structure will be constructed to conform to the architecture on the property and will be in line with
other neighboring properties.
3. The Board finds that the variance of 100% is substantial, however substantiality of the variance is
mitigated by the lacic of visual impact to neighboring properties, as well as by the conditions noted
below.
4. The applicant has demonstrated this variance will not have an adverse physical or environmental
effect on the neighborhood. Permeability will meet the district requirement.
5. The alleged difficulry may be considered self-created insofar as the applicant's desires to build an
accessory with finished space, but this is not necessarily fatal to the application.
Conditions: No cooking facilities, overnight stays, or bathing facilities are permitted.
It is so moved, March 14, 2022.

This variance shall expire 18 months following the filing date of such decision unless the necessary
building permit has been issued and actual construction begun as per 240-8.5.1.
I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning
Board of Appeals of the City of Saratoga Springs on the date above mentioned, seven members of the
Board being present.
