Re: 269 Broadway Proposed Mixed Use Commercial Building
We have watched with alarm the process regarding the above referenced project. Public comments via email and letters
are difficult to find in the archives, and many appear to be missing, including reference to our petition with over 800
si�natures collected in just 9 days last Fall. This raises the question of whether the Planning Board ("PB") and Design
Review Commission ("DRC") members have seen those public comments, especially as some members have changed in the
past year. And opportunities for the public to speak at the PB and DRC meetings have been scarce, despite assurances
from PB staff. This has allowed some false impressions from the applicant to go unchallenged,such as:
1. No si�nificant new iobs will be generated from this project. The only committed tenants are the applicant's
businesses which will vacate current offices at 85 Railroad Place.
2. The SPA Catholic"easement" is for access to a walkway only, which already exists for 260 Broadway(Death Wish
Coffee)for access to their parking lot on Hamilton. The green space and surface parking lot belong to SPA
Catholic. This will cause confusion for deliveries and visitors to the building's main entrance on the south side.
3. The project is zero lot line on a narrow deep sloping lot and will extend all the way to the public sidewalk.
Although that is not clear on the applicant's sketches and architectural layouts,the zero-lot line (no setback) is
unlike any neighboring building on Broadway or Hamilton.
4. The transformers are positioned on the SPA Catholic property although they do not appear in the applicant's
sketches.
5. Despite the mature trees in the sketches, no existing tree on the property can remain on this zero-lot line project.
The beautiful 60-foot tree on the city property east of the Broadway sidewalk will most I,ikely be damaged and
removed unless the building is set back sufficiently.
6. Although the building address is Broadway and the 70-foot height limit is based on the minor entrance in the
middle of that fa�ade, little of the building can be accessed from Broadway. The building will be 83 feet on the
Hamilton side, rising 4-6 stories above all the neighboring buildings on Hamilton. The building will be a half story
taller than Park Place Condominiums on the east side of Broadway. Park Place is setback and pancaked to greatly
reduce its visual impact. A mechanical tower on the roof of the project will add another 13 feet. SEE EXHIBIT 1.
7. The under�round sara�e will be reserved for the applicant's business. All other tenants, and their business and
retail customers will have to find parking on the street. About 24 cars currently park on the undeveloped lot
during the business/school week. They will also have to find parking on the street. SEE EXHIBIT 3E.
Our concerns listed below are for the impact on our neighborhood and the nearby downtown district. See the following
exhibits for further documentation.
1. Mass &Scale SEE EXHIBIT 1.
• The project will loom over neighboring buildings. Helium balloons flown at the project corners& high
points would help visualize this.
• Facades are mostly flat walls with little pancaking or setbacks unlike rr�ost large Saratoga buildings.
2. Aesthetics SEE EXHIBIT 2.
• Glass and steel (especially in a historic neighborhood)are not the Saratoga Springs look that attracts
visitors.
• The Broadway fa�ade is not pedestrian friendly.
• Overwhelming immediate reaction of petition signers:
o Too big and ugly.
o Does not fit with historic neighborhood.
o Reminds us of an "ocean liner" parked on the lot.
3. Traffic/Deliveries/Parkin� SEE EXHIBIT 3.
• Hamilton and Broadway have one lane in each direction with parking on both sides of street. There are
no public parking lots in this neighborhood. During the business week,special events and on Sunday
mornings, parking is often not easy to find.This massive a project will worsen this problem.
• Delivery trucks frequently block traffic while parked in the driving lane (downtown Broadway has the
advantage of two lanes in each direction and vehicles can more safely get around the parked trucks).
They also block the driveways of neighborhood buildings. Large Sysco trucks that will be delivering to the
restaurant will create an even larger problem and are likely to block 269 Broadway's garage entrance as
well.
• The main entrance positioned on the south side will naturally attract delivery trucks and visitors to the
SPA Catholic parking lot. This may pose a hazard for the students and staff on their own property.
4. Li�ht& Noise Pollution
• Significant nighttime light pollution and noise will be created for existing residential neighbors from
second-floor restaurant and the large amount of glass throughout this office building.
• The sheer wall of the Broadway fa�ade will bounce and exacerbate the current traffic noise from cars and
large trucks as they decelerate downhill to Congress Park. Vehicles often need to brake at the crosswalk
light at the northeast edge of the project or at the light at Congress Park.
5. Public Safetv SEE EXHIBITS 3 &4.
• There are too many curb cuts, especially on Hamilton. The increased traffic and deliveries resulting from
this building will dramatically increase the risk to vehicles and pedestrians. The risk population includes
students at SPA Catholic, senior citizens visiting the Senior Citizen Center, health center patients and
others trying to enter or exit their buildings.
• The half-submerged open air covered walkway on the southeast side of the main floor is not pedestrian
friendly and is a potential magnet for homeless looking to camp out.
• There are facilities within 1500 feet of the projects that serve children,the elderly and disabled (school,
senior center, health center). The effects on the safety of these populations must be carefully researched.
6. Aquifer SEE EXHIBIT 5.
• The applicant has indicated in its Environmental Assessment Part 1 E.2 that the project site is located
over, or immediately adjoining, a principal aquifer and that the avera�e depth of the water table is iust 12
feet! This property has never been excavated to the depth of a two-story underground garage. What
impact will it have on the aquifer and the basements of the surrounding buildings? Saratoga has many
examples of construction disturbing the springs and aquifer resulting in flooding of neighboring
basements. We need to protect the aquifer system which is part of the city water supply. We need to
protect the springs which are part of our tourism economy.
7. Public Opposition SEE EXHIBIT 2.
• In gathering over 800 petition signatures in just 9 days last Fall, we shared the applicant's sketch of the
Broadway fa�ade. The facade has changed little since. The public reacted very negatively to the massive
scale and design incompatible with the historic neighborhood.
We support city development. However,this zero-lot line modern project on this narrow sloping lot towering over its
primarily two-story neighbors is completely inappropriate for this site. The project poses a risk to health, safety, and
inadequate city infrastructure. This is historic Saratoga Springs with a tourism economy, not The Bund of Shanghai.

This action has inadvertently brought to the fore several traffic problems that exist
beyond the action but will be magnified by the action as regards tratfic and public
safety. This action cries out a traffic study and for attention and cooperation between
the Land Use Departments, the Mayor's Office and the Public Safety Department.
The proposed action will result in a substantial increase in traffic above present levels and
generate substantial new demand for transportation facilities or services?
The applicant has answered this question in the affirmative with no solutions as per the
action. A traffic study that evaluates accompanying safety issues is warranted based on the
following facts:
There are 11 curb cuts and three crosswalks on Hamilton Street within the boundaries
noted.
Those curb cuts are egresses in and out of a school parking lot, Senior Center, Church
parking, Hotel, Apartment Complex, Hospital Clinic, Private Parking Lot and the
parking garage and loading dock of the proposed action.
The increase in traffic precipitated by the 269 tenants and the parking garage can only
create additional traffic and safety issues with school buses loading and unloading,
deliveries (there are no commercial parking spaces on Hamilton Street) and a four-
way stop within a half of block of a traffic light on the south end of Hamilton Street

Hamilton Street is a two-lane street with parking allowed on both sides of the street.
The width of the street is further compromised in the winter with plowing to the curb.
The second part of the question refers to the time for peak traffic expected. The
applicant checked boxes for morning and evening. The response to this question also
warrant's a complete traffic study:
School buses and parent pick-ups peak between 7:45 — 8:15 and 2:00 - 2:30 pm with
additional traffic from student drivers and faculty. Pick-ups and drop-offs continue until
approximately 6:00 pm to accommodate sports practice and games.
Hamilton street is heavily used as an alternative route to Broadway between
3:30 pm and 6:00 pm daily and throughout the day during the racing season and
during high volume events downtown.

The major traffic issues the action will exacerbate on Broadway are the following:
Inadequate parking for deliveries, customers and employees of the action will
increase traffic, parking needs and safety issues.
The address of the building is on Broadway. That will naturally draw
deliveries to park at the front of the building and on Broadway.
Broadway is a two - lane street from Circular Street to Congress Street with
parking allowed on both sides of the street which creates safety issues when
vehicles park in the drive lane to make deliveries.
Broadway is also NYS Route 9 which draws 18 wheelers, and other large
vehicles throughout the day. This volume of traffic creates visibility issues when
delivery vehicles are in the drive lane.
Traffic traveling on Route 9 which is a straight-away, are traveling at a faster
speed until traffic comes to the intersection of Congress Street and Broadway
where there is a traffic light.
Approximately 2/3 of the way north of Circular Street on Broadway there is a
pedestrian traffic light that interrupts the flow of traffic.
There are no Commercial Parking spaces on Broadway between Circular Street
and Congress Street. Consequently, deliveries (moving trucks, food deliveries,
USPS, UPS, FedEx, Amazon, linen service etc.) park in the drive lane or in no
parking zones.

Is the project site located over or immediately adjoining, a primary, principal or sole source aquifer?
The planned action is located over or immediately adjoining a principal aquifer.
An aquifer is a geological formation capable of yielding a significant amount of water to a spring.Aquifers act as
underground reservoirs,storing water they also act as conduits or pathways for the movement of water. Both the
quantity and quality of groundwater can be adversely affected by land development activities.
The Environmental Assessment Form indicates that they will be excavating 20 feet but that the water table is at
12 feet. What impact will this have on the aquifer?At the Sketch Design Meeting the applicant responded that
they can not move the transformers inside because National Grid will not allow it due to the water table.
There are three types of aquifers:
1. unconsolidated deposit aquifers—lie below a permeable layer of soil
2. bedrock or confined aquifers—have a layer of impenetrable rock or clay above them.
Sub-surface water fills the spaces between particles of rock and soil (ground water)to wells and springs.
3.quaternary aquifers—created by glaziers, located between bedrock and the earth's surface.They can
be confined or unconfined.
Aquifers come in different types and have various ways of distributing water.
First things first, an aquifer is not an underground lake or river. There is not a huge chasm under your
feet holding water that you could float a boat on. It is actually made of permeable rocks, sandstone and
other porous materials. Water is easily able to move around in this drenched storage area.

There are two basic types of aquifers; confined and unconfined. A confined aquifer happens when water
in porous layers is trapped by layers that are relatively impermeable, like granite or dense clay. Confined
layers tend to be under pressure and typically are saturated throughout. Unconfined layers are where
ground water is located. This is water right under the soil, the top of this is considered the water table.
