NOTICE OF DECISION
IN THE MAI�fER OF THE FINAL SUBDIVISION APPLICATION #ZOZ I I I 69 OF
PEARL STREET SUBDIVISION
I PEARL STREET
SARATOGA SPRINGS, NY I 2866
Involving the premises with Tax Parcel ID# I 65.42-2-22.2, in the City of Saratoga Springs, on an application
for final plat review of a proposed two-lot subdivision within the Urban Residential — 2 (UR-2) District with
the Planning Board who met on January I 3, 202 I and made the following decision(s) by a 5-0 vote (In favor:
Torpey, Horton, Mayo, Doty, Marshall).
In accordance with SEQRA regulations 6NYCRR Part 6 I 7 and after review and evaluation of the SEQRA short
Environmental Assessment Form Parts I and II, made a motion to issue a Negative SEQRA Declaration on
January I 3, 202 I ;
And, in accordance with requirements set forth in the City's Subdivision Regulations, the Planning Board
issued the following decision:
C� Approve the final subdivision plat with the following conditions:
• Removal of existing fire pit or area variance from the side yard setback prior to signing of the final plat.
• Existing Maple trees along the W. boundary line shall be preserved.
• Existing Maple trees above shall be protected during construction and corresponding tree protection
detail to be added to the site details sheet of the final plan set.
• Sidewalk to be extended across the existing driveway.
• Final plans shall be to the satisfaction of DPW.
• Payment of the fee in lieu of dedication of recreation lands for one new lot.
The applicant is required to complete the following as per the City of Saratoga Springs Subdivision Regulations:
• Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on- and
off-site improvements.
• Submit a fee in lieu of recreation of $2,000 for each new residential lot per Appendix A of the
Subdivision Regulations.
• Submit two (2) mylar and two (2) paper copies of the final approved subdivision plat for signature by
the Planning Board Chair.
• File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as
provided in Article 3, Section 32 of General City Law.
This approval shall expire if not enacted within I 80 days as set forth in the City of Saratoga Springs
Subdivision Regulations Article II, Section I. D. I 5.
