Re: SCPB Referral Review #19-28 (see also 18-50)-Special Use Permit-Allen Drive
Apartments
Construction of 202 apartment units (90 units in 7 bldgs, 112 units in 5 bldgs.)
and 5,000 SF of commercial space (office, NFP) in 2 Phases, located in newly
rezoned T-4 District.
Location: Church Street (NYS Route 9P), Allen Drive and Tait Lane
Received from the City of Saratoga Springs Planning Board on March 4, 2019.
Reviewed by the Saratoga County Planning Board on March 21, 2018.
Decision: Approve
In May of 2018 the proposed project was reviewed by the Saratoga County Planning
Board for a proposed zoning change from WD to T-4. In effect, the zoning change
which was approved/adopted already proclaims the project conforms with the city's
Comprehensive Plan and that the use conforms to and is compatible with the
surrounding neighborhood and its uses. The surrounding districts are residential (T-
5, T-4 and UR-4), with mixed use developments of T-5 zoning on Washington Street,
Station Lane and Church Street. The responsible agent for the city has indicated that
there is a sufficiency of sanitary sewer and municipal water. Regarding traffic impacts
and possible means of mitigation, DOT and the city planning board will have to review
site access, turn movements, intersection/stopping sight distance, and issue any new
curb cut, if necessary. These latter issues will be matters of further review by the city
planning board under site plan review, but in regard to the
REVIEW STANDARDS FOR A SUP, the following are under consideration:
1. To what extent is the use in harmony with, promotes the general purposes and intent of
the Comp Plan, zoning. ord., and health, welfare and safety of city/residents?

2. How are the project's use or uses affect neighborhood compatibility, have impact(s) on
community character (adjoining properties), and is the proposed density conform to the
surrounding area?
3. What impacts will the proposed uses have on vehicular congestion and parking?
4. Impacts on infrastructure and services?
5. Impacts on long-term economic stability and community character.
Our reviews of both May, 2018 and March, 2019 find that there is nothing of adverse impact
presented in the material provided and reviewed that would present a reason not to approve
the issuance of a Special Use Permit, as requested by application.
