Following up on our meeting among Vince DeLeonardis, Esq., you, and I of March 21,
2018, our firm has been retained in connection with the above entitled action. In this regard, I
am enclosing (i)two copies of Mr. Tommell's letter to Chairman Torpey of November 27, 2017
and (ii) two sets of new plan sheets (S2A dated 4/11/18 and S2B dated 11/20/17). We are also
forwarding digital copies of this letter to you with attachments.
I have reviewed the webcast of the September 28, 2017 Planning Board meeting and the
November 27, 2017 Planning Board agenda workshop. During the workshop session,there was
considerable discussion about the accuracy of the drawings, specifically relating to the location
of out-buildings toward the rear of the property. Since that meeting, I have asked Jason
Tommell to reconfirm the locations on the drawings. He has done so.
I also noted your comment to Board members of the importance of a site visit for those
members who have not yet been to the site. I certainly agree that this would be a valuable
exercise for members. In advance of that site visit, we will ensure that we provide you with a
description of the flags on the site and a key to the mapping so that members can better
understand what they are viewing during their visit.
In order to make the best use of the Planning Board's resources,Jason and I would like to
meet with you to ensure that we fully understand the Board's identification of the lands on the
site whose conservation values are the most important to preserve(Section 241-1203)(2)(b)).
At that point, we would want to be in a position to have the Board assess the preliminary plat to
ensure that its determination on the conservation analysis is properly reflected on that plat and
depicted with our identification of the land to be permanently preserved by a conservation
easement. In our view, the narratives provided in (i)the conservation analysis appended to the
application on August 24, 2017 and(ii) Mr. Tommell's letter to Mr. Torpey of November 27,
2017,provide the Board with sufficient detail, description and analysis to undertake its findings.

Project Overview:
Cerrone Builders is proposing a 2-lot conservation subdivision of 138-148 Old Schuylerville
Road (Tax Map No. 167.00-1-27.21), located on the south side of Old Schuylerville Road,
across from its intersection with South Point Road. The applicant is interested in constructing 2
single-family homes on the new lots. These homes will be served by on-site septic systems and
municipal water.
The parcel is located in the Rural Residential (RR) zoning district. Subdivisions within the RR
Zone are subject to the Conservation Subdivision Requirements.
The front of property is undulating predominantly well-drained sandy soils with a hill about 200-
feet from Old Schuylerville Road. The rear 300-feet +1- of the property appears to have been
used as a part of the previous owner's heavy construction business. This area has been graded
flat and is quite compacted--resulting in no significant vegetation or habitat areas.
Conservation Analysis
Features of the property that are considered constrained under the Conservation Subdivision
Regulations are steep slopes greater than 2,000 contiguous square feet.
We have not observed any significant environmentally beneficial characteristics of the property.
The steep slopes occupy 27,421 Sq. Ft. or 14% of the parcel. The development will be
established between the hill and Old Schuylerville Road, continuing the development pattern of
the area. The construction of the homes will impact a portion of these steep slopes, mostly with
grading.
Recreational Resources
A proposed bike trail system is the only identified, potential recreational resource on a map
entitled, "City of Saratoga Springs Open Space Resources 2002," made by The Saratoga
Associates and Behan Planning Associates.
Proposed Development
The proposal establishes 2 single-family homes fronting on Old Schuylerville Road_
Conservation Enhancement
There are no significant habitat communities or wetland on the property. There is, however, an
opportunity to increase the subject parcel's contribution to the conservation value of the area, in
accordance with recommendations of the City of Saratoga Springs Comprehensive Plan. This
can be achieved by establishing the back portions of the property as a meaningful buffer to the
core area of wildlife habitat, located to the south. There is a wetland network south of the
proposed development. This network is north of NYS Route 29 and connects to Bear Swamp.
The applicant is proposing an 82,937 sq. ft. conservation easement encumbering the back
portions of the lots. This area will initially be enhanced through deep ripping and decompaction.
