Involving the premises at 153 S. Broadway with Tax Parcel ID#178.27-1-22 through 29, in the City of
Saratoga Springs, on an application for a permanent special use permit for 110 multi -family
residences, 21,000SF of office, 7,500SF of eating and drinking establishment, and up to 7,000SF of
retail uses within the Transect -5 Neighborhood Center (T-5) District with the Planning Board who met
on September 14, 2017 and made the following decision(s) with a 7-0 vote (In favor: Torpey, Totino,
Casey, Bristol, Fabozzi, Wolfson, Horton):
• In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation
of the SEQRA full Environmental Assessment Form Parts I and II, made a motion to
approve the issuance of a SEQRA Negative Declaration of environmental significance.
• Following evaluation of the identified six standards for the issuance of special use permit as set
forth in 7.1.3 of the City of Saratoga Springs Zoning Ordinance, moved to approve the
permanent special use permit with the following considerations:
1. All outdoor activity shall cease by 11pm nightly.
2. Proposed project consists of separate access to first and second level parking from S
Broadway and Union Street respectively. Any modification to this will require review
by the Planning Board.
3. The applicant agrees to consider LEED certification and energy efficiency practices,
to be reviewed under site plan review.
Unless otherwise extended by the Planning Board, this approval shall expire if the applicant fails to
comply with any required conditions and start actual construction, or otherwise implement this
approval within 18 months from this date.
