HomeMy WebLinkAbout20210764 13 Bowman Subdivision Sewer Line Agreement SEWER-LINE EASEMENT AGREEMENT AGREEMENT made , by and between: , residing at 13 Bowman Street, Saratoga Springs, NY 12866, the first party, and , residing at 15 Bowman Street, Saratoga Springs, NY 12866, the second party, WITNES SETH: WHEREAS, the first party is the owner of real property commonly known as 13 Bowman Street, Saratoga Springs, NY 12866, the first party, (hereinafter referred to as "Parcel 1"), more particularly described as follows: All that tract or parcel of land situate in the City of Saratoga Springs, Saratoga County, NY, bounded and described as follows: Beginning at a point on the westerly line of Bowman Street at the southeast corner of lands of now of formerly of Steven Ethier as recorded in the Saratoga County Clerk's Office in Book 1593 of Deeds, page 516, being the northeasterly corner of the parcel herein described. Thence along the westerly line of Bowman Street, S07°51'00"E, 60.00 feet to a point. Thence along the northerly line of the Lot 2, S82°07'28"W, 125.00 feet to a point. Thence along the easterly line of lands now or formerly of Kathleen E. Collum as recorded in the Saratoga County Clerk's Office in Liber 1471 of Deeds, page 341, N07°51'00"W, 60.00 feet to a point. Thence along the southerly line of lands now or formerly of George M. Roman, Jr. and Amy Sue Roman as recorded in Book 1731 of Deeds, page 18 and lands now or formerly of Steven Ethier, N82°07'28"E, 125.00 feet to the point of beginning. Containing 7,500 square feet or 0.172 acre of land.; WHEREAS, the second party is the owner of real property commonly known as 15 Bowman Street, Saratoga Srings, NY 12866, (hereinafter referred to as "Parcel 2"), more particularly described as follows: All that tract or parcel of land situate in the City of Saratoga Springs, Saratoga County, NY, bounded and described as follows: Beginning at a point on the west line of Bowman Street at the northeast corner of lands now or formerly of Donald Coon as recorded in the Saratoga County Clerk's office in Book 1100 of Deeds, page 224, being the southeast corner of the parcel herein described. Thence along the northerly line of lands now or formerly of Donald Coon, S82°07'28"W, 125.00 feet to a 5/8" iron rod found. Thence along the easterly line of lands now or formerly of Kathleen E. Cullum as recorded in Liber 1471 of Deeds, page 341, N07°51'00"W, 60.00 feet to a point. Thence along the southerly line of the Lot 1, N82°07'20"E, 125.00 feet to a point. Thence along the westerly line of Bowman Street S07°51'00"E, 60.00 feet to the point of beginning. Containing 7,500 square feet or 0.172 acre of land.; WHEREAS, the above parcels of real property are adjacent and contiguous to one another, and there presently exists a common and shared private sanitary forcemain/sewer-line (hereinafter referred to as "sewer-line") along the municipal right of way along the western boundaries of each respective lot, as more particularly shown on the Map, dated November 12, 2021, by The LA Group and attached hereto as Exhibit A, and made a part hereof; and WHEREAS, the parties desire to define and clarify their respective rights and duties concerning ownership, use, maintenance and repair of the sewer-line; NOW, THEREFORE, in consideration of the mutual promises of the parties, the parties agree as follows: 1. Neither party shall obstruct, cause to be obstructed, or otherwise interfere with the other party's reasonable use of said shared sewer-line. 5. The parties shall bear equally the cost and expense of maintaining the sewer-line in good, safe, and proper condition and repair. 6. Neither party shall permit the sewer-line to suffer from waste, misuse, or neglect. 7. This Agreement and all negative and affirmative covenants of the parties hereunder shall be deemed covenants running with the land of the respective parties and shall bind the respective heirs, successors and assigns of the parties.
