In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA short Environmental Assessment Form Parts I and II, made a motion to issue a Negative SEQRA Declaration on October 28, 2021; Having properly noticed and conducted a public hearing on October 28, 2021 as required on the proposed use; And, upon evaluation of the application based on the City's enumerated criteria to ensure that the proposed use(s)will not adversely affect surrounding properties and community character; And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7.1 "Special Use Permit",the Planning Board issues the following decision on October 28, 2021 (passed 5-0—in favor: Horton, Fabozzi, Mayo, Dal Pos, Pipia): Issued a permanent special use permit for a private/civic club defined in the zoning ordinance as "a social, fraternal, religious, or service organization not primarily operated for profit nor rendering a service that is customarily carried on as a business". This use is permitted on lot 2 (9,450 sq. ft.) of the adjusted and subdivided rear of the current 74 Mitchell St. (166.70-1-17). Lot 2 will be commonly-owned and maintained by seven adjoining residential properties—(lots 1 1, 12, 14, 15, 16, 17 and 18 as adjusted by lot line adjustment PB#20210847 and a portion of lot 17 (lot I) as subdivided PB#20210924). Ownership, management and maintenance of lot 2 will be specified within restrictive covenants and deeds within the HOA documents. The use is permitted per the submitted sketch plan including amenity area consisting of a cabana and pool area for the exclusive use of the above lot owners and their guests. Conditions: Conveyance of an easement to the City of at least .03-acre portion of a parcel on the corner of Union Ave. and Page I of 2 East Ave. to the satisfaction of the City Attorney for future civic space amenities, site and design details to be determined by the Planning Board and DRC in the future. Hours of operation for the cabana and pool shall be sunrise to I I pm daily. The pool shall be fenced and secured as required by the zoning ordinance and building/pool permits. Site plan review and approval required to implement the SUP. Note: this approval shall expire 18 months from the issuance date unless all conditions have been complied with and actual work begun.
