NOTICE OF DECISION
In the matter of the final subdivision application #18.017 of
Witt Subdivision
32 Hyde and 9 Birch Streets
Saratoga Springs, NY 12866
Involving the premises with Tax Parcel ID#165.73-2-41 . 11 , in the City of Saratoga Springs, on an
application for a three lot final residential subdivision within the Urban Residential-2 (UR-2) District
with the Planning Board who met on July 19, 2018 and made the following decision(s) with a 6-0 vote
(In favor: Torpey, Totino, Van Wagner, Casey, Fabozzi, Ryan):
1 . In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the
SEQRA short Environmental Assessment Form Parts I and II, made a motion to approve the issuance
of a SEQRA Negative Declaration of environmental significance.
2. Permitted sidewalk construction or repair within general west side neighborhood in lieu of
constructing sidewalk along the Birch Street property frontage. Details shall be coordinated among
applicant, Planning and City Engineer and will be subject to Planning Board Chair approval.
3 . In accordance with Article VII Waiver of the Subdivision Regulations, issued a waiver of conveyance
of ROW along Hyde and Birch Street frontages as required due to all four provisions being met.
4. Mature Silver Maple tree located along the southeast property boundary shall be preserved and
protected during construction with detail to be provided on final plans. City Arborist shall be
consulted with and provide input on tree preservation on lots in general.
The applicant is required to complete the following as per the City of Saratoga Springs Subdivision
Regulations:
• Submit a fee in lieu of recreation of $2,000 for each new residential lot per Appendix A of the
Subdivision Regulations.
• Submit two (2) mylar and two (2) paper copies of the final approved subdivision plat for signature
by the Planning Board Chair.
• File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as
provided in Article 3, Section 32 of General City Law.
This approval shall expire if not enacted within 180 days as set forth in the City of Saratoga Springs
Subdivision Regulations Article II, Section I. D. 15.
