I re- main opposed to the use variance requested for 85 Nelson Avenue. Here are my specific concerns: 1. Short-term nine-month leases are offered for the 3 units at 85 Nelson Avenue. Those tenants are then required to move out in favor of more lucrative but very brief stays by racecourse attendees. At the end of the racing season, short-term nine- month lessees once again move in. This results in a very high rate of turnover and significant instability. It fundamentally changes the nature of the quiet, safe, and stable neighborhood that we have invested in for 30 years. 2. The owner has said that he intends to continue to reside at 85 Nelson Avenue and to maintain the property as "owner-oc- cupied". At the same time, he recently was in discussions re- garding the potential sale of the property to more than one indi- vidual. Recently, he has been residing elsewhere. If the use variance were approved — if the property were then sold — it is not possible to ensure that further changes to the oversight/management of the property would not unfold, again changing our quiet neighborhood and potentially adversely af- fecting our longtime investment in our home. 3. The owner purchased 85 Nelson Avenue in a private sale. Despite his background in the banking/lending industry, he did not pursue this zoning issue at the time of this transaction. Due diligence was lacking. This request for a use variance has been submitted at a very late date —and only because the owner was forced as a consequence of necessary repairs to the prop- e rty.
