It was required that full payment be made by the end of January 2020 for that stay. Two checks made out to Blue Star LLC, totaling the amount of $900 were mailed to Springs Motel In January 2020 and cashed by Springs Motel in January 2020. The Springs Motel policy states any cancellation needs to be made within 75 days prior to your reservation. I called the Springs Motel and left several voice mail messages asking for a return phone call. I emailed the Springs Motel explaining the situation and asked for a refund on 5/11/20. I sent a certified, return receipt requested letter on 5/8/20 to the Springs Motel asking for a refund. To date, no response to my calls, email, or letter. On 7/10/20, I called the motel and "Bill" answered. Bill, who claimed to be the manager, basically told me he would not give me a refund; however, Bill told me he would apply the $900.00 to a stay next year (2021). I asked Bill to send me an email confirming he would put the $900 toward next year and he stated he WAS NOT going to send me an email. My complaint is that I paid for a four night stay in advance, I met the required cancellation policy terms, and I have not received a refund. I can't get in touch with anybody at the desk no return emails i am trying to find ought about reimbursement due to the race track not allowing the public in. I talked to the chamber of commerce there having numerous complaints regarding the same complaint about the Springs motel. There owned by Blue Star Enterprise i am getting no response from them either. My reservations are at the end of July no contact since January. Complaint Type: Problems with Product/Service Status: Unanswered 06/08/2020 We were contracted that our reservation for 8/19/20 needed to be cancelled by 5/27/20 in order to receive a full refund. We have been emailing daily since 5/23/20. The emails have been returned undeliverable due to the mail box being full. As of 5/29/20 the emails have not been returned as undeliverable but no response has been received. We have called daily since 3/18/20 and able to leave a message on voice mail but to date no response. Customer Response 06/19/202Q I would like to add some updated information to my complaint #********. On 6/17/20, I received a phone call from Betty. She stated she was a Housekeeper at the Springs Motel and was returning my call. She stated no refunds would be given, you show up for your reservation or not and to make sure you make your reservation for next year. I asked to speak to the Owner because not receiving a refund is against the contract. She gave me the phone number ###-###-####. She said this is the phone number for the corporate office and she disconnected the call. On 6/17/20, I attempted to call the given phone number. There was no answer and a recording the voice mail was not set up. On 6/18/20, I received a phone call from a male stating he was from the Springs Motel. He did not give a name. He asked why I had called and left a message. I explained that I wanted a refund to my cancellation of my reservation. He said "I don't know if you are aware but there was a disease spreading around and the hotel was closed down, I do not appreciate you calling". I told the man that I do not appreciate his comment and wanted a refund as the contract states. He told me to call July 1 st when the motel is open and disconnected the call. On 6/18/20, I attempted to call ###-###-####. Again, no answer and a recording the voice mail was not set up. Thank you, ******* **** Complaint Type: Problems with Product/Service Status: Resolved 05/27/2020 $471.21 (check # **** paid to Blue Star Enterprises, cashed 1/21/20) was sent on January 3, 2020, for full payment of a motel stay on June 26,27,28, 2020. This was required for the weekend of the Saratoga, N.Y. Jazz Festival. I was told that a full refund would be forthcoming if the festival was cancelled because of Covid 19, as long as the request was made by June 6, 2020. However, I have left multiple phone messages which have been ignored, and have also sent a certified letter which, to date, has not been picked up. Customer Response 06/16/2020 Received a call from the consumer stating that the business has refunded her$471.21. Complaint resolved. Complaint Type: Billing/Collection Issues Status: Unanswered 05/04/2020 On January 14, 2020 I made a reservation at the Springs Motel for a 3-night stay from August 12 through 14, 2020 with a check for $675. On April 27 & 28, 2020 I phoned the motel to cancel the reservation. Each time, the answering machine stated that they were "busy with a customer" and to leave a name, phone number and detailed message. I did.that and after failing to get a response both times, I sent an email to springsmotel@*****.com on April 29 again stating my desire to cancel the reservation in addition to requesting a full refund.. I also mentioned their lack of response to my phone calls and asked then to email a confirmation and the approximate time it would take them to honor my request. Again, no response. I then made another phone call on May 1 at 2:05 p.m. and left my phone with the message that I was interested in August availability. Two hours later at 4:05 P.M. I received a call from a gentleman named Dana R**** (not sure of the last name but that what it sounded lik... Expand Complaint Details Complaint Type: Problems with Product/Service Status: Unanswered 04/28/2020 for refund I requested verbally on 4/7/2020. deposit for 8/12-8/13 & 9/3-9/6/2020 6 nites for a total of $1,407.71 ck #**** made to: blue star enterprises. cashed on 1/21/2020. we have made numerous phone calls to the springs motel and left vm none which have been returned. emailed chamber of commerce advised to call police department for non emergency which I called and they told me keep calling. also sent them an email on 4/24/2020 no reply from them. Complaint Type: Billing/Collection Issues Status: Unanswered 03/04/2020 Motel was closed before office hours. We arrived at 8pm, and office hours were listed as ending at 9pm. My key was in an envelop e taped to the door. The key did not open the room we were assigned. I called the motel using 2 different numbers several times and no one picked up. They responded back at noon the following day. They did not let me into the room that I had paid for, and they are refusing to refund my money. I have photo and video evidence that is time stamped to prove all of this. I had pre-paid the $1,000 USD for the room on February 1, 2019. On August 7, 2019 I had called to cancel the reservation because I had to remain at home to take care of a disabled family member. I was never provided with any information about the cancellation policy at the Motel nor was I given any written or oral notice of a cancellation policy. The man on the phone who identified himself as an employee kept calling me "big shot" and refused to speak with me about the situation. He hung up and refuse any further phone calls. I made several daily phone calls to the Springs Motel to try and resolve this issue and the calls were never returned. I had provided more than 20 days of notice to this establishment and they refuse to return my phone call or payment. I have been a patron of this motel for more than half a dozen years and am distraught by the treatment I received. I have no doubt they were able to rebook my room in the time I provided as they keep a waiting list for those wishing to stay there. As a result, they were unfairly and unjustly enriched by retaining my payment all to my loss. I am seeking full restitution and hope that by lodging this complaint your agency will take action which will deter this Motel from engaging in similar unfair and oppressive business practices. Your intervention will also protect other victims and vulnerable consumers from unfair misappropriation of consumer money.
