NOTICE OF DECISION
In the matter of the application
#20210243
I 9 Washington St. Development— Rip Van Dam Hotel Expansion
I 9 Washington Street/353 Broadway
Saratoga Springs, NY I 2866
Involving the premises with tax parcel no. I 65.67-I-I 4, I 5, I 8.I & 70 in the City of Saratoga Springs, on an
application for site plan review for a proposed +/- 200,000 sq. ft. mixed-use building, including 85 residential
units, 33 hotel rooms, and approximately 600 sq. ft. commercial retail space and associated site work in the
Transect—6 Urban Core (T-6) district.
In accordance with SEQRA regulations 6 NYCRR Part 617, the Planning Board identified the proposed action as
Type I, Coordinated Review as required, and as the designated Lead Agency for the review, evaluated the Long
Environmental Assessment Form Parts I and II, and made a motion to issue a Negative SEQRA Declaration on
June 24, 2021.
And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter
240, article 7.2 "Site Plan Review",the Planning Board issues the following decision on July 29, 202 I (passed 5-0
in favor: Torpey, Horton, Fabozzi, Mayo, Doty, Dal Pos):
C� Approve site plan set with revision date July 29, 202 I with the followin�conditions:
• Final details of the civic space design shall be reviewed and approved administratively by the
Chair.
• New granite curbing shall be installed along the Washington St. frontage.
• The applicant shall return to the DRC for clarification and reconfirmation of prior demolition
approval.
• A construction staging plan shall be included in the final plan set.
• Final plans shall be provided to the satisfaction of the City's designated engineer, DPW and
DPS.
• The applicant shall submit a fee in lieu of dedication of recreation lands for each residential unit.
The applicant is required to:
I. Deliver a letter of credit or cash escrow in the amount approved by DPW to the City per Article 7.2.I 5 of
the Zoning Ordinance. This must occur prior to final signature by the Planning Board Chair.
2. Submit one (I) mylar and two (2) paper copies of the final approved site plans for signature bythe Planning
Board Chair within ei�hteen (I 8) months of approval as per Article 7.2.I 2 of the Zoning Ordinance.

Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not
started actual construction as per Article 7.2.I 4 of the Zoning Ordinance.
