Following discussion and evaluation of 10.2.6. 1 . 1 of the Zoning Ordinance the Planning Board issued the following advisory opinion by a 4-0 vote (In favor: Torpey, Fabozzi, Pipia, Dal Pos): • Issued a favorable opinion on the requested text amendment to extend the expiration date of Zone B of the PUD from July 1 , 2012 to July 1 , 2024. This change to Section XI of the PUD, entitled Expirations would read, "Planned unit development zoning approval shall expire if final PUD site plan approval for the first building in Zone B is not granted on or before July I , 2024". • Issued an unfavorable opinion on the requested text amendment to include "Warehouses, Distribution Plants and Wholesale Establishments" upon Site Plan Review approval within the PUD use schedule. The Board found that the current PUD language does not comport with the Community Mixed Use (CMU) designation in the Comprehensive Plan and therefore additional language would need to be included in the PUD that reflects the Transect — 4 Urban Neighborhood (T-4) or Transect — 5 Neighborhood Center (T-5) design standards within the Zoning Ordinance. Alternatively, the City Council could consider a zoning map amendment that reverts the parcels from PUD to T-4 or T-5. If you have any questions regarding the above, please contact me.
