Comments Thank you for sending me notice about the use variance re-
quest to 85 Nelson Avenue. I have lived at 93 Nelson Avenue
for the past 30 years and am concerned about potential ad-
verse effects were this request approved.
When I called City Hall last week to inquire about current zon-
ing on our street, I was told that Nelson Avenue is zoned UR-2,
single family residence. Our neighborhood of homes consis-
tently tries to maintain a quiet, orderly, and well-kept appear-
ance. We are fortunate to have proximity to restaurants (such
as Mexican Connection) and there is a renovated hotel down
the street, but these businesses are not part of our residential
neighborhood. The nearness of Saratoga Racecourse and op-
portunities for parking cars on lawns during the meet briefly al-
ter the atmosphere in our neighborhood for 6 weeks in the latter
part of the summer. Permitting this use variance has the poten-
tial to set a precedent for further such requests, and I am con-
cerned this would fundamentally change the character of our
neighborhood.
Review of the application indicates that this property has been
in use as a 3-family since its purchase in 2013, if not earlier.
What has triggered the current formal request for use variance?
How has this continued without being addressed sooner? Were
this property to change hands in the future, it seems possible
that another structure could replace the existing home — and
were the use variance approved now, the new (3-family) struc-
ture proposed could very well be something not in keeping with
the character of this neighborhood.
