NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION #20210588
TOP DOG ENTERPRISES SUBDIVISION

SARATOGA SPRINGS, NY 12866
Involving the premises with tax parcel #165.34-I-7 and 165.34-1-9, in the City of Saratoga Springs, on an
application for final subdivision plat review of a four-lot residential subdivision within the Urban Residential —
District with the Planning Board who met on July 15, 2021 and made the following decision(s)with a 5-0
vote (In favor: Torpey, Horton, Doty, Dal Pos,Jenks):
In accordance with 6 NYCRR Part 617, the Planning Board classified this request as an Unlisted Action.
Ei Issued a Negative SEQRA Declaration on April 30, 2020.
Ei Issued preliminary subdivision plat approval of a four-lot residential subdivision as per the requirements set
forth in the City of Saratoga Springs Subdivision Regulations with conditions on Feb. 25, 2021.
Q Issued final subdivision plat approval of a four-lot residential subdivision as per the requirements set forth in
the City of Saratoga Springs Subdivision Regulations with the following conditions on July 15, 2021:
• Replace the water and sanitary sewer infrastructure along the southern side of lot 4.
• Remove light fixture on the existing utility pole on Seward St. and replace with decorative street light
within the tree belt along applicant's frontage on Seward per DPW satisfaction with coordination from
National Grid.
• No blasting shall occur on the property during site work or for future home construction.
• One tree shown on private property to be relocated to ROW on Van Dorn.
• Add easement for emergency vehicle turnaround at the end of lot 4 on Van Dorn. Easement language
shall be to the satisfaction of the City Attorney.
• Final plans shall be to the satisfaction of DPW and the City's Designated Engineer.
• Applicant to improve stormwater management by infiltration and/or use of porous pavement.
• Use variance for the day care center shall be extinguished with implementation of final subdivision
approval.
The applicant is required to complete the following as per the City of Saratoga Springs Subdivision Regulations:
• Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on-and
off-site improvements.
• Submit a fee in lieu of recreation of $2,000 for each new residential lot per Appendix A of the
Subdivision Regulations.
• Submit two (2) mylar and two (2) paper copies of the final approved subdivision plat for signature by
the Planning Board Chair.
• File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as
provided in Article 3, Section 32 of General City Law.
This approval shall expire if not enacted within 180 days as set forth in the City of Saratoga Springs
Subdivision Regulations Article II, Section I. D.15.
