ELIGIBILITY:To apply for relief from the City's Zoning Ordinance, an applicant must be the property owner(s) or lessee, or have an option to Iease or purchase the property in question. The Zoning Board of Appeals (ZBA)shall not accept any application for appeal that includes a parcel which has a written violation from the Zoning and Building Inspector that is not the subject of the application. 2. Revised 01/2019 ZONING BOARD APPEAL APPLICATION INSTRUCTIONS PAGE 2 PUBLIC HEARING ADVERTISEMENT The Zoning Board of Appeals is required to hold a public hearing on each submitted application within ninety(90) days from when it is determined to be properly complete by City staff. City staff will prepare a legal notice for the public hearing and arrange to have the public hearing announcement printed in The Saratogian legal notices at least 5 days before the hearing. Applicants must pay The Saratogian for the legal ad and present proof of payment to the ZBA prior to the public hearing. If proof of payment is not presented prior to the hearing,the hearing will be cancelled. PROPERTY OWNER NOTIFICATION Applicants are required to mail a copy of the public hearing legal notice to all property owners within the following distances from the boundaries of the land in question: Type of variance Distance for property owner notification Use variance 250 feet Area variance&Interpretation 100 feet This notice must be sent at least 7 days but not more than 20 days before the date of the public hearing. Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have been explored(alternative designs,attempts to purchase land,etc.)and why they are not feasible. The accessory building is an open post and beam shed covering a stone and clay pizza oven and barbecue grill. The shed preserves the clay oven from disintegration from the elements and is designed to distribute any smoke away from the enclosed oven or grill from the neighboring property. The oven is built of stone starting at a depth of 4 feet below ground level and cannot be moved. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: The accessory building is barely visible from the road, is blocked visually by the house,trees and yard plantings, is architecturally aesthetic,fits in with the character of the neighborhood and will be painted consistent with the primary house colors for which we have received recognition for Outstanding Achievement in Maintenance&Painting by the Saratoga Springs Preservation Foundation. The open shed benefits the nearest adjoining property by directing smoke away from that property. Additionally,due to concerns articulated by the adjoining neighbor,a gutter was added to the roof which will deflect any rainwater or snow from going onto the neig1ooring property. The requested variance is not substantial for the following reasons: The shed and roof occupy most(approx.3')of the four foot setback,so the requested variance is substantial. However,the overall area within the setback is only 11%of the property line, next to the neighbors garage(which is likewise built within the setback), and the structure does not block any views or otherwise adversly impact the neighbor. 4. Whether the variance will have adverse physical or environmental effects on neighborhood or district. The requested variance will not have an adverse physical or environmental effect on the neighborhood or district for the following reasons: The variance will help preserve native materials used in the construction of the pizza oven and will dissapate any smoke created by outdoor grilling or use of the pizza oven. It has no detrimental effect on the neighborhood or district and has a positive effect in smoke diversion and water runoff. 5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance).Explain whether the alleged difficulty was or was not self-created: I built the pizza oven in 2010 and placed it in the only available space in a back yard,which is less than 1,110 square feet. In order for the shed to preserve the oven and dissapate the smoke it has had to be built within the side yard setback,but harms no one or no other property interest and adds value to the neighborhood.
