To grant an area variance,the ZBA must balance the benefits to the applicant and the health,safety,and welfare of the neighborhood and
community, taking into consideration the following:
I. Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have
been explored (alternative designs, attempts to purchase land, etc.) and why they are not feasible.
The Benefit can not be achieved by other feasible means:
a)Additional land was already purchased along the South property line (portion of Cedar Alley)to make the project feasible.
No other land is available for purchase on either the South or North to minimiize the min. North side setback or total sides,
b)The existing roof along the North side of the house is pre-existing/non-conforming at 2.4'to the front porch roof.This condition
is not preferred. Minimizing the porch size also does not change the total side yard setback variance required.
However,there are currently windows along the South side of the house which the Owners would like to remain. The garage
width at 16'will allow for a car and storaqe alonq the side wall for the family ski equipment Also there is a need for a mudroom
entrance into the house from the garage area. The need could not be met if the adtlition was shifted North.
d) The full addition cannot be placed to the West of the existing house without minimizing the usable back yard and tree removal.
2. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby
properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood
character for the following reasons:
Granting the variances should not produce any undesirable change in the character of the neighborhood as the garage:
a) A block garage already exi t in th th general area of th n ���g^r^ge addition A n ��� ipdated ��ge and entry o�r y r�
will improve the aesthetics of the house&neighborhood.
b) The house alread exists at 2 4'side setback from the North propert line at the front porch The new covered porch will be
further away from the side property than pre-existing conditions. Also, the new porch is proposed to have a full wall along the
Northern side to provide for more privacy to neighbors.

3. Whether the variance is substantial. The requested variance is not substantial for the following reasons:
The variances appear substantial, however due to pre-existing/non-conforming conditions, they may be viewed as not
substantial:
a) The min. side yard setback of 4.8'to the proposed covered porch results in a 3.2'variance(40%). Although this may appear
the Northern property line and "gains yard space"as the house extends towards the West. As the house has a 2.4'setback,a 4.8'
setback to the new porch may be viewed as not substantial
b) The total side yard setback variance of 11.5'(43%)may appear substantial. However,the new side yard setback of 9.1'to the
pre-existing/non-conforming at 2.4'from the North property line,the total side setback relief of 40% may be viewed as not
substantial.
4. Whether the variance will have adverse physical or environmental effects on neighborhood or district. The requested variance will not
have an adverse physical or environmental effect on the neighborhood or district for the following reasons:
The variances requested should not have any environmental effects on the neighborhood or district:
a) No large trees will be removed for the proposed additions. (The addition location is actually proposed so as to save a tree).
b)The proposed new rear covered porch is offset 12"from the North wall of the existing house so as to minimize drainage issues

c) The Owners have already substantially improved drainage conditions on their property when they purchased the portion of
Cedar Alley. The new addition on the South side will not drain off propert
d)Keeping the house addition "compact"with the house and more forward/East of the lot allows for more green open space to
the back yard to enhance neighbors' lots.
5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance).Explain
whether the alleged difficulty was or was not self-created:
The alleged difficulty was self-created as to the Owners'desire to improve and expand their existing home for their elderly parents
to live with them (not an in-law apartment). However,the pre-existing/non-conforming conditions of the narrow lot and house
location(house built in 1930)were not self created.
