Papa,Jr. Site Acquisition Consultant 11 Par Circle, Albany,New York 12208 518-365-9711 /joseph.a.papa@gmail.com July 19, 2021 City of Saratoga Springs Attn: Development Review Commission c/o Amanda Tucker, RA City Hall 474 Broadway Saratoga Springs,NY 12866 Re: Architectural Review Application- Upgrade to Collocated Communication Facility on monopole/light tower off Nelson Avenue Applicant: Sprint Land Owner: Saratoga Casino Holdings LLC Tax Map Parcel ID: 179.-5-7 Site ID #: AL03XC031 /UP40627A Dear Amanda: On behalf of applicant Sprint we are submitting an Architectural Review for a proposed upgrade to an existing communication facility collocated on the existing monopole light tower located off Nelson Avenue on the Saratoga Hotel Casino parcel in the City of Saratoga Springs. The proposed Sprint communication facility upgrade will consist of the following: - replace six (6) existing panel antennas with nine (9) newer model panel antennas, together with new mounting hardware on the existing monopole light tower; - remove nine (9) of twelve (12) existing Remote Radio Heads (RRHs/RRUs) and replace with six (6)newer model RRHs, together with new mounting hardware on the existing monopole light tower; - replace cabling between antennas on monopole light tower and radio equipment on ground with new cabling; - replace two (2) existing electronics cabinets on existing concrete pad with two (2) newer model electronics cabinets; - remove currently vacant antenna mount at approximately 90 ft. on monopole light tower; - install new 48 KW generator, together with fuel tank to be located on a new 4 ft. x 10 ft. concrete pad within existing fenced compound area; - replace existing tower steel reinforcing plates with new reinforcing plates between 0 ft. to 15 ft. and 30 ft. to 50 ft. on existing monopole light tower; City of Saratoga Springs Development Review Commission July 19, 2021 Page 2 - together with associated mounting hardware and supporting equipment as more particularly detailed in the enclosed engineering drawings by Tectonic Engineering, last revised July 19, 2021. The proposed replacement antennas, RRHs and cabinets are similar in color and materials as the existing antennas, RRHs and cabinets. They are dull light gray in color and made of plastic and steel. This project includes the removal of a currently vacant/unused antenna mount on the light tower at approximately 90 ft. on light tower; Additionally, the proposed cabinets and replacement generator are located behind existing fencing and screened from public view. See enclosed photos of existing conditions. Specifically, in support of this Architectural Review Application we are enclosing the following: 1) Architectural Review Application; 2) Two (2) sets of Construction Drawings by Tectonic Engineering, last revised July 19, 2021; 3) New York State Short Environmental Assessment Form Part 1 (completed) and Part 2; 4) Photographs of exiting site conditions and location map; 5) USB flash drive with Digital Versions of this Application and Supporting Materials; and 6) Check for the Design Review Commission application fee in the amount of$140.00. Additionally we would like to point out that this project qualifies as an "Eligible Facilities Request" under Federal Law, Section 6409 of the federal Middle Class Tax Relief and Job Creation Act of 2012, which was signed by the President into law on February 22, 2012 and provides that simple collocations and/or equipment upgrades such as those depicted in this application must be approved by State and local governments. This federal law specifically provides that: "a State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station." (Emphasis added). An"eligible facilities request" is defined as "(A) collocation of new transmission equipment; (B) removal of transmission equipment; or(C) replacement of transmission equipment." (Emphasis added.) The law(Section 6409) authorizes the immediate installation of these eligible facilities to help improve the economy, create jobs, and speed the deployment of the wireless services they provide. "Substantial change" to the physical dimension of such tower or base station includes the following in its definition but they do not result here: "it increases the height of the tower by more than 10% or by City of Saratoga Springs Development Review Commission July 19, 2021 Page 3 the height of one additional antenna array with separation from the nearest existing antenna not to exceed twenty feet, whichever is greater"; or "adding an appurtenance to the body of the structure that would protrude from the edge of the structure by more than six feet". 74 U.S.C. Section 1.40001(b)(7). It is respectfully submitted that Sprint's proposed modification which consists of the collocation of new and replacement transmission equipment will not substantially change the physical dimensions of the existing base station and must be approved as an eligible facilities request pursuant to Federal Law Section 6409.
