St. Pter's City Hall Batcheller Mansion July 12, 2021 To: Saratoga 5prins Planning Boarc! Design Reiew Cammission Mayor Meg Kelly Commissioner of Pubic Works 51cip Scirocco Commissioner of Public Safty Robin Dalton Re: 269 8raadway Proposed Mixed Use Cnmmercial Building We have watched with alarm, the process rearding tE above referenced projeet. Publie comments aia email and letters are difficult ta find in the archives, and many appear ta be missing, including reference to our qetition with ouer$a sinatures collected in just 9 days last Fal. This raises the qcestion of whether the Planning Board ("PB") and Design Reiew Commissian {"DRC"} members have seen thase public comrr, ents, esecially as some members hae changed in the past year. And opportunities for the public to speak at the PB and DRC meetings have been scarce, despite assurances fram PB staff. ThFs has allowd some false impressians from the aaplicant to ga unchallenged, such as: 1, Np sinificant new iobs will be generated from tis project. 7he anly committed tenants are the applicant's busEnesses which will vacate current oftices at 8S Railroad Pface. 2. The SPA Catholic "easemert" is for access to a walkway only, which already exists for 26Q Broadway(Death Wish Coffee}for access to their parking lot on Hamilton. The gren space and surface parking lot elong to SPA Catholic. This will cause confusion for delieries and visitors tthe buifding's main entrance on te south side. 3. 1"he project is zero lot line on a narrow deep sloping lot and will xtertd all the way to tie pulic s3dewalk. Althougitha is not clear on the app9icant's sketches and architectural layouts, the zeo-Eat fine(no setback) is unlike any neighboring building nn Broad+,vayr Hamilton. 4. The transformers are pasitioned on the 5PA Catholic property aathoughhey do not appear in the applicant's sketches. 5. Despite the mature trees in the sketches, no existing tree an the property can remain an this zero-lot line praject. The beautiful 6D-foot tree on the city aroperty east of the Broadway sidewalk will mast likely be damaged and removed snless the building is set back sufficiently. 6. Although the building acEdress is Broadway and the 70-foot height limit is based on the minor entrance in the middle of that faade, little of the building can be accessed from Broadway. The building wial be$3 feet on the Hamilton side, rising 4-6 stories above all the neighboring buildings on Hamilton. The building will be a halstory taller than Park Place Condominiums on the east side of Broadway. Park Plce is setback and pancaked to greatly recuce itsisuaa impact. A mechanical towe€-on the roof af the project will add another 13 feet. SEE XhIIB17 1. 7. The underround arae will e resered far the applicant's usiness. AEI other tenants, ancthir business and retail customErs will have to fincf parEcing on the street. About 24 cars currently park on the undeelaped lat during the business/scool week. They will also hae to find parking pn#he street. SEE EXHIBIT 3E. Qur concerns 9isted beiow are for the irnpact on aur neighbarood and the nearby downtown district. See the following exhibits for fur#her dcacumentation. 1. Mass &Scale SEE EXhtIBIT 1. • The project will loflm oer neighboring iuildings. Helium balloons#lown at the project corners & high points would help uisualize this. • Facades are mostly flat walls with ]ittie pancEcing nr setbatl<s unlike most large 5aratoga buildings. 2. Aesthetics SEE EXHIBIT2. • Glass and steel (especially in a historic neighborhood) are not the 5aratoga Sarings look that attracts visitors. • he Broadway fa4ade is nat pedestrian friendly. • O+rerwhelming immediate reaction af petition signers: o Tac big and ugly. o Does not fit with historic neighborhood. c Reminds us of an "acan iiner' parked on the lot. 3. 7raffit/Deliveries/Parkin SEE EXH181T 3. • Hamilton ard Broadway have one lane in each cfirection with arking on both sides af street. There are no public parking lots in this neigttborhoaI. During the business week, special even#s and on Sunday mornings, parking is often not easy ta find. This massie a Aroject will worsen#his problem. • Deliery trucks frequently black traffic while parked in the driving lane (dawntown Broadway has the adantage of two lanes in each direction and uehicles can more safely get around the parked trucks). 7hey also 61ock the driveways of neighborhoocf buildings. Large Sysco trucks that will be deliering to the restaurant wifl create an even larger probEem and are likelyto block 269 Broadwy's garage entrance as well. • The main ntrance positoned on the south side will naturally attract delivery trucks andisitors to the SPA Catholic parking lot. Ths may pos@ a hazard for the studen#s and stafon their own propety, 4. Light & Noise Pallution • Significant nighttime light pollution and n4ise will be created for existing residential neighbors from second-floor restaurant and the large amont o#glass throughout this office buifding. • The sheer walf af the Broadway faade will bounce and exacerbate the current traffic noise from cars and large trucks as they decelerate downhill to Congress Park. Vehicles often need to brake at the crosswalk ight at the northeast edge af the project or at the light at Congress Park. 5. Public Safety SEE EXI-lBlTS &4. • There are too manyurb cu#s, especially on Hamilton. The increased traf{ic and deliveries resulting fram this building will dramatieally increase t#e risk ta ueicles and pedestrians. The risk papufation includes students at SPA Cathalic, senior citiznsisiting the Senior Citizen Center, health center patients and others trying to enter or exit their builcfings. • The half-subrrlerged open air cavered wallcway on the southeast side of the main flaor is not pedestrian #riendly and is a potetial magnet for horreless looking to camp aut. • There are facilities within 1500 feet of the projeets that serve chidren, the elderly and disabled (schaol, seniar center, halth center}. The effects on the safety of these populations rnust be carefully researched. 6. Aquifer SEE EXHIBIT 5. • The applicant has indicated in its Environmaental Assessment Part 1 E.2#ha#the pro}ect site is located over, or irnmediately adjoining, a principal aquafer and that the aerae deptit of the water table is iust 12 feet! This praperty has ner been excavated ta the cepth of a two-story unclerground garage. What impaet will it have on the aquifer anJ the baserr7ents othe surrounding buifdings? 5aratoga has many examples af constructior disturbing the springs and aquifer resultFng in flooding of neighboring basements. We need to protect the aquifer system which is part of the city water supply. We need to prqtect the springs whic are part of aur tourism economy. 7. Public Opposition SEE EXHIBIT 2. • in gatiering over S00 petition signatres in just 9 day5 lasfi Fal, we shared the applicant's sketch of the Broadway faade. The facade has changed little since. The public reactedery negatively to the massive scale and design incampatible with te historic neighbarhood. We suppart city development. Howeur, this zera-lot line modern praject on this narrow slaping lot towering oer its primarily two-story neighbors is completely inappropriate for this site. 7hE project posEs a risk to health, safety, and inacEequat city infrastructure. 7his is historic 5aratoga Springs with a tourism economy, not The Bund of Shanghai. EIIBIT 3C Enviranmental Assessment Form Part I-TRAFFIC D2-J BROADWAY The major traffic issues the action wiEl exacerbate on Broadway are the following: 9nadequate parking far deliveries, customers and employees of the action will increase traffic, parking needs and safety issues. The address of the buiiding is on Broadway. That wi11 naturally draw deliveries to paric t the frnnt of the building and an Broadway. Broaway is a two - lane stret from Circular Stret ta Congrss Street with parking alfawed on both sides of the street which creates safety issues when vehicles park in the drive lane to mak dliueries. Broadway is also NYS Route 9 which draws 8 wheelers, and other large vehicles tFroughou# the day. Thi volume of traffic crates visibilify issues when delivery vehicles are in the drive lane. The planned action is lacated over or immediate3y adjoining a principal aquifer. An aquifer is a geological formation capable af yieldig a signifEcant amount oF water to a spring. Aquifers act as underground reservoirs, storing water they also act as conduits ar pathways for the movement of water. Bott the quantity and quality of groundwater can be adversely affect2d by land deelopmnt activities. Th Enviranmental Assessment Form indicates that they wili be excaating 20 feet but that the water table is at 12 feet, What impact will this have on the aquifer? At the Sketch Desin Meeting the applicant responded that they can not move the transformers inside because National Grid will not allow it due to the water table. There are three types of aquifers: ].. unconsodidated deposit aquifers—lie below a permeable layer of soil Z. bedrock or cofined aquifers—have a layer af impenetrable rock ar clay abave them. Sub-surface water fills the spaces hetween particles of rock and soii (ground water)to wells and springs. 3.quaternary aquifrs—created by glaziers, locaed between bedrock and the earth`s surface. They can be confined or uconfined. Aquifers came in differenf typs and have variaus ways of distributing water. First things first, an aquifer is not an urderground lake or river. There is no# a huge chasm under yur f:et iolding water that you could float a boat on. It is actually made of perrneable rocks, sandstone and other porous rnaterials. Water is easily able #o moe around in this dfenched storage area. c:h 7rryc r.rc..a 6scMear±e3 Ari.• 3/ . Pun,:u] .'atl ,^,:rannx , - 1n ._n"-:cl..:cui'er ,,' +,' .f} _ Y , Canfrtaoiged • fY. i..FCR!luS"er 1*a>;3rR .'
