A use variance is requested to permit the following:
We are requesting a use variance for the freestanding sign to be 25 SF (12.5 SF per tenant), from the current 6 SF that
was granted in 1994.
For the Zoning Board to grant a request for a use variance, an applicant must prove that the zoning regulations create an unnecessary
hardship in relation to that property. In seeking a use variance,New York State law requires an applicant to prove all four of the following
"tests".
I. That the applicant cannot realize a reasonable financial return on initial investment for any currently permitted use on the property.
"Dollars¢s"proof must be submitted as evidence.The property in question cannot yield a reasonable return for the following
reasons:
The property is located on an isolated section of Route 50, in a 45 MPH zone.The size limitation of 6 SF, which in turn allows
3 SF (18"x24"-a standard political lawn sign) per tenant, would result in a logo that would not be viewable/readable given the
speed of traffic. By relocating the corporate offices of Saratoga Today from 424 Broadway in downtown Saratoga, to this
location on a main entrance path into Saratoga,we wish to have sufficient visibility for both businesses.

2. That the financial hardship relating to this property is unique and does not apply to a substantial portion of the neighborhood.
Difficulties shared with numerous other properties in the same neighborhood or district would not satisfy this requirement. This
previously identified financial hardship is unique for the following reasons:
There are very few businesses along this section of Route 50.The closest one is the Abundant Life Church, directly north of the
location of Saratoga Today.That property has a similar size sign as we are requesting, as well as a wall mounted sign of
approximately 25 SF.
Further North of that is Caliber Collision (previously Enterprise Rental), which has a much larger freestanding sign with internal
illumination.The area variance request we are seeking is to allow us to have similar signage, but non-illuminated, to the other
businesses on this section of Route 50.

3. That the variance, if granted, will not alter the essential character of the neighborhood. Changes that will alter the character of a
neighborhood or district would be at odds with the purpose of the Zoning Ordinance. The requested variance will not alter the
character of the neighborhood for the following reasons:
We are not seeking an area variance that would require internal illumination of the sign,which would be similar to the
neighboring businesses. We are simply looking to have the similar size as our business neighbors.The sign is not an aluminum
cabinet with a plexiglass face, but instead is painted and carved dimensional letters, similar to the requirements of most
signage found in the more classic Historical District of Saratoga Springs.
4. That the alle�ed hardship has not been self-created.An applicant(whether the property owner or one acting on behalf of the property
owner)cannot claim "unnecessary hardship" if that hardship was created by the applicant,or if the applicant acquired the property
knowing(or was in a position to know)the conditions for which the applicant is seeking relief.The hardship has not been self-created
for the following reasons:
When purchasing the property along this section of Route 50, and seeing the existing signage of neighboring businesses, it
was assumed that a sign of similar size would be allowed. When submitted to the DRC, the aesthetics of the sign exceeded
those of neighboring businesses, and we feel this will enhance the property significantly for people viewing the property as they
travel north into Saratoga Springs.

To grant an area variance,the ZBA must balance the benefits to the applicant and the health,safety,and welfare of the neighborhood and
community,taking into consideration the following:
I. Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance ha�e
been explored (alternative designs,attempts to purchase land,etc.)and why they are not feasible.
With this being a freestanding sign along Route 50,there are no other options for identifying the business that would be visible
to traffic as they travel north or south along that section of road.A building mount wall sign would not be visible given the
setback of the building, and the trees surrounding the building.The property is perfectly setup with a 15 car parking lot,to
accommodate a freestanding sign however.
2. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby
properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood
character for the following reasons:
We feel that a tastefully designed freestanding sign, that meets and exceeds the design criteria for not only Architectural
District, but Historical District, would enhance the visual appearance of the property, and help to represent Saratoga Springs as
the Saratoga Today logo incorporates the iconic"Royal Blue"color of Saratoga.

3. Whether the variance is substantial. The requested variance is not substantial for the following reasons:
The requested area variance of 25 SF is equal to, or less than,the current size of other businesses within a 1/2"mile of our
offices.Also, we are not asking for a variance of size and illumination,only size, unlike the other businesses which also have
internal illumination.
4. Whether the variance will ha�e adverse physical or environmental effects on neighborhood or district. The requested variance will not
ha�e an adverse physical or environmental effect on the neighborhood or district for the following reasons:
There will be no physical obstruction with the sign at 25 SF versus 6 SF. It will however allow emergency personnel the ability to
locate the property in the event they need to respond to a call, and they are looking for a business name.
5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance).Explain
whether the alleged difficulty was or was not self-created:
We feel that this is not a self-created hardship simply for the reason that the property is located in an isolated area that has
been designated a RR zone, versus a commercial zone. The property was approved for business use in 1993, and received
approval for a 15 parking spots. Based on that,the property appears to be a commercial business, and for that reason we are
asking for the area variance so that the signage matches the aesthetics of the property.

APPEAL TO THE ZONING BOARD FORAN

APPLICATION REQUIREMENTS
1. E����B�uN:To apply for relief from the City's Zoning Ordinance, an applicant must be the properry owner(s)
or lessee, or have an option to lease or purchase the property in question. The Zoning Board of Appeals (ZBA)
shall not accept any application for appeal that includes a parcel which has a written violation from the Zoning
and Building Inspector that is not the subject of the application.
2. CoMP�ETE SuBM�ss�oNs: Applicants are encouraged to workwith City staff to ensure a complete application.
The ZBA will only consider properly completed applications that contain 1 original and 1 digitalversion of the
following:

PUBLIC HEARING ADVERTISEMENT
The Zoning Board of Appeals is required to hold a public hearing on each submitted application within ninety(90)
days from when it is determined to be properly complete by City staff.
City staff will prepare a legal notice for the public hearing and arrange to have the public hearing
announcement printed in the legal notice section of a local publication at least 5 days before the hearing.
PROPERTY OWNER NOTIFICATION
Applicants are required to mail a copy of the public hearing legal notice to all properry owners within the following
distances from the boundaries of the land in question:

The mailing must be certified by the U.S. Post Office. Prior to the public hearing,applicants must present the Post
Office "certificates of mailing" to the ZBA. If"certificates of mailing" are not presented prior to the hearing, the
hearing will be cancelled.
