IN THE MATTER OF THE APPEAL OF
Thomas Lacobelli

determination involving a parcel at
Arrowhead Road, in the City of Saratoga Springs, New York, being Tax Parcel 192.12-1-63
on the assessment map of said City.
The applicant having applied for an area variance under the Zoning Ordinance of said City to
permit the construction of a single family residence in the Suburban Residential 2 (SR-2)
District and public notice having been duly given of a hearing on said application held on June
7 and July 12, 2021.
In consideration of the balance between benefit to the applicant with detriment to the health,
safety and welfare of the community, I move that the following area variance for the following
amount of relief:

As per the submitted plans or lesser relief, be approved
the following factors:
1. The applicant has demonstrated this benefit cannot be achieved by other means feasible
to the applicant. The applicant wants to construct a single-family home on a vacant lot on
the corner of Arrowhead Road and Tomahawk Lane. The applicant notes that alternative
options for the design of the new construction were explored, but due to the unique
three front setbacks, the
benefits sought by the applicant are not able to be accomplished without the requested
variance.
2. The applicant has demonstrated that granting this variance will not create an undesirable
change in neighborhood character or detriment to nearby properties. Per the applicant, the
proposed new constructionhas been designed to be architecturally and aesthetically
consistent with neighboring homes. In addition, the applicant notes that the proposed plans
were revised to position the proposed structure further from the closest neighboring
property and its principal structure.
3. The Board notes the requested variance is not substantial.
4. The applicant has demonstrated this variance will not have an adverse physical or
environmental effect on the neighborhood. Permeability will meet the district requirement.
5. The alleged difficulty is considered self-created insofar as the applicant desires to build
the new construction. However, this is not necessarily fatal to the application.
It is so moved.

This variance shall expire 18 months following the filing date of such decision unless the
necessary building permit has been issued and actual construction begun as per 240-8.5.1.

the Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned,
six members of the Board being present.
