This Project has already received approvals for a Lot Line Adjustment, Special Use Permit, Site Plan Approval and SEQRA negative declaration from the Planning Board. The reason that this Project is appearing before the Zoning Board is that after all of the approvals were obtained, it was determined that a map that was supplied to the LA Group which showed the County Water Authority's thirty (30) foot Easement to be on the east side of the County Sewer Line Easement was in error. Once we began to work on the financing of this project, it was determined that the map we had been supplied with had been erroneous and in fact, the Water Easement is to the west of the sewer line and extended beneath the approved building. Because of that, the building plan had to be modified and repositioned, becoming smaller, to allow it to continue to work as our client's corporate office. We could not shrink it enough within the limited building window that exists on this site and as a result, we have had to move Ms. Susan Barden, Senior Planner March 4, 2019 Page 2 the building into the West Avenue setback. However, the building that we intend to construct is no further into the setback than the already existing building on this site. I will be calling you tomorrow with regard to a conference on this Project, as this Project is now on a significant financing deadline which we would ask the City to take into consideration in the placement of this Project on any future Zoning Board Agenda.
