Watervliet,NY 12189-4000 RE: Wetland Delineation and Isolated Wetland determination for Tait Lane property, City of Saratoga Springs, New York ACOE project# NAN-2014-00646. Dear Christine, Enclosed with this letter are maps and photographs representing the property referenced above. Wetland data sheets that document the wetland delineation work that was completed by Copeland Environmental LLC and a formal wetland report, including the wetland jd checklist will follow shortly. We are sending this information in support of our determinations that all of the wetlands on the site are isolated from the tributary system and have no nexus to the regulated waterways under your jurisdiction. Our review of the property shows that the site and the wetland area located on the site do not flow off the property and therefore may not be considered waters of the United States, as discussed below. Please review this information in preparation for your field visit. Tait Lane Isolated wetland determinations. The site is located in a flat landscape and is surrounding by a railroad corridor and a utility line corridor on its eastern boundary, and NY State Route 9N on its northern boundary. Residential homes and an apartment complex surround the other sides of the property. The site was previously used for farming. Evidence of farming and soil borrowing were found on the site. The soil survey indicates that the soils are a sandy loam throughout the site and the area. These are not known to be wetland soils. The site is not mapped within a flood plain and there are no streams identified on the site. The NWI map shows one wetland on the site located in the eastern central portion of the property. This wetland is not shown to extend across the rail road property to the east and in the field it does not extend across the rail road line. There is a mapped DEC wetland within 500 feet of the eastern portion of the property. However field investigations indicate that this state regulated wetland does not extend on to the property. This wetland is located south east of the Tait Lane Property and it is separated from the Tait lane property by uplands. There is no evidence that there was One wetland in this location and there is no evidence of any connection to There are no culverts or any other drainage structures that connect the DEC wetland and the wetlands delineated on the Tait Lane Site. . Northwestern Wetlands A and B - Data sheets taken in and in between the wetlands in the northwestern section of the site where wetland A and B are located demonstrates that the wetlands are seasonally wet and separated by upland areas. These wetlands are not connected to each other or to the tributary system. They do not drain to any other wetland or tributary on the site. We reviewed the entire property and found no culverts carrying drainage off site from these two wetland areas. The wetlands are located in depressions in the landscape where it seems that soil borrowing may have occurred at one time. The soils appear to be native; but the shallow depth of topsoil is not representative of the mapped soil type. The site is flat and water just seems to collect in these areas or come up from seasonal groundwater table. There are no outlets for this water to drain off site. Wetland BB is located on the eastern portion of the property. This wetland is wetter than the other wetlands on the site. Vegetation and hydrologic evidence is much more definitively wetland than the other wetlands on the site. We reviewed the rail road property, the edge of the rail road tracks, the utility line corridor and the site boundaries. There are no culverts carrying flow across the rail road tracks or across route 9N. There are no ditches or other drainage ways carrying flow to the tributary system. The wetland just ends along the tracks and the utility corridor. Uplands develop along all sides of the wetland, making it isolated from the tributary system. In some instances the ACOE can consider a wetland connected to the tributary system if it is neighboring, or if there is a manmade structure or fill that separates the wetland from the tributary system. A rail road track or roadway is an example of something that could have been constructed and divided a wetland in two. This does not appear to be the case at the Tait Lane site. There is at least 300 feet of upland area across the rail road tracks or more. Upland woods are located at east of the developed rail road area and there is not indication that filling in wetlands has taken place at the site. One ACOE jurisdictional wetland was confirmed to be present on the rail road property. However this wetland is well away from wetland BB and there are no culverts carrying flow to this area. Several isolated wetland determinations were made by the ACOE to the east and south east of the site, including one area with has a no significant nexus determination near the corner of NYS Rte 29 and West Ave, southeast of Tait lane site. Although these determinations do not directly affect the Tail Lane determination, it is clear that isolated and other non-jurisdictional are practical and possible in this landscape position. Wetland BB appears to have developed as water has been trapped on the site after topsoil and farming activities have compacted the soils and created depressions. Topsoil borrowing could also have an effected this wetland. In addition, increased development of the years may have affected the groundwater and storm drainage accumulation at the site. Overall there is no evidence that Wetland BB is currently, or ever was part of the tributary system. It is not adjacent to or neighboring a regulated water body, and it certainly has different habitat type than other wetlands in the area. Provided to you to document the findings made herein are; flood plan maps, national wetland inventory maps,NYS wetland and stream maps, Topographic map, Flood plain Map, Tax Maps, wetland data sheets, soil survey map,photographs, and a wetland survey. We believe that the findings in the field will confirm the determination that the wetlands are isolated. MCNeary, IV Denton Road, LLC 22 Beacon Hill Drive Saratoga Springs, NY 12866 Dear Mr. McNeary: On June 11, 2014, the New York District of the U.S. Army Corps of Engineers g received a request for a Department of the Army jurisdictional determination for a 13.81 acre site that is currently owned by Denton Road, LLC, and 14 Tait Lane, LLC. This request was made by Copeland Environmental, LLC, as our consultant. The site is . y located in the Hudson River watershed, along the south side of Tait Lane in the City of Saratoga Springs, Saratoga County, New York. The proposed project would involve the establishment of a residential development. The submittal received by this office on June 11, 2014, included a proposed delineation of the extent of potential waters of the United States within the project . p J boundary. A site inspection was conducted by a representative of this office on July 30 2014, in which it was agreed that changes would be made to the delineation and that the modified delineation would be submitted to this office. On August 21, 2014 this office received the modified delineation. Based on the material submitted, including the drawing entitled "Wetland . Delineation Map, Tait Lane Residential, Tait Lane, Saratoga Springs, NY" re prepared b �p p Y Creighton Manning Engineering, LLP, dated June 4, 2014, and last revised August 7 20'14, and the observations of the representative of this office during the site inspection, . g p , it has been determined.that based on the U.S. Supreme Court decision Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers, No. 99-1178 January 9, 2001), the wetlands shown on the above referenced drawingdo not meet the current criteria of waters of the United States under Section 404 of the Clean Water Act. These areas are identified as Wetlands A, B1 and B2 and consist of a total of 3.09 acres of wetlands within the subject 13.81 acre property. The Court ruled that isolated intrastatewaters can no longer be considered waters of the United States, based solely upon their use by migratory birds. PLEASE USE THE ABOVE 18 -CHARACTER FILE NUMBER ON ALL CORRESPONDENCE WITH THIS OFFICE This determination regarding the delineation shall be considered valid for a period of five years from the date of this letter unless new information warrants revision of the determination before the expiration date. This determination was documented using the Approved Jurisdictional Determination Form, promulgated by the Corps of Engineers in June 2007.
