First there are two lots, one being the parking lot and one housing the main building and garage, and this application is for the improved parcel. 2. It states there is no written violation, but I have seen letters written by Mr. Steve Shaw dating back at least 2-3 years that he informed them they were in violation 3. The semi portable statement is a great injustice. This is a patio that was constructed with no permits. It houses a built in gas grill and bar seating area,the cover is a temporary one. 4. This is basically on the property line and the intrusion from what was there when we moved into the neighborhood is drastically different. 5. The gathering of the bar area is may or may not be in violation of NY State liquor authority as separate permits are required for the exterior service and gathering with seating 6. They are most likely way over on coverage, again keep in mind two lots and one is a totally paved parking lot, while I have attached pictures that show a small piece of greenspace for the second lot with the building.They have had numerous surveys so proof of coverage should not be an issue. My estimation is that they have 10%open, based on a google map measurement. Response to their answers for the variance: 1. They had a rear yard and chose to put it where it is, hampering egress is ridiculous.They could move it to the side and as far as the Pergola,that is nowhere near the rear gated entrance or rear door,they have plenty of room to accomplish what they want without being on the property line.The pergola is approximately 15'from their rear door, so ingress and egress is not an issue, but moving it to be within code should not be either. 2. The alteration is the gathering of large groups of people in a rear yard which started with an approximate 10' x 10' patio and a grill into this large gathering and party spot which goes on for numerous hours into the night 3. The environmental impact is the much larger gathering and party space.There will soon be additional homes across the alley and this brings into effect a large outdoor party spot,that did not previously exist with no approvals by the municipality 4. Mr. Shaw had letters that I saw and discussed with him during the time they constructed this and I personally saw the letter that said they were subject to daily fines and in violation, they should be in the building file. They should have had approvals to begin with to mitigate any of the above concerns, instead I actually called the fire marshall as they were installing a propane tank next to the property line and building that he made them move. I indicated to members they needed permits and they said no they didn't and kept going. I hope you deny this variance or force them to come into compliance with the zoning code. 1 Please see the pictures as the ones they have submitted are truly mis leading for what is there.There are pictures before it was completed as well as recent.
