Total Side Setbacks: (2.3'variance= 19.2%) 12.0'min. 9.7' Principal Building Coverage: (3.2%variance= 10.7%) 30% max. 33.2% Other: To grant an area variance,the ZBA must balance the benefits to the applicant and the health,safety,and welfare of the neighborhood and community, taking into consideration the following: I. Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have been explored (alternative designs, attempts to purchase land, etc.) and why they are not feasible. a)The 7'-6"master suite addition is small in size and serves to create additional storage. The existing house has limited storage and the basement crawl space is difficult to access. Removal of this addition does not achieve the benefit of more storage or larger 1st floor suite. b) The existing front stoop roof extends 0.8' beyond the front property line. The proposed porch roof is necessary for structural integrity as well as covered access to the house. The proposed porch roof has been minimized to fit within the front property line. A smaller porch roof area would have limited functionality. c) The existing stairs and bath along the left side of the house have compromised headroom as the side knee wall exists at only .-'.. - • .•• . .- .. ..- -•- •• -'- -- ---- • '• - -- .--. -... '- -' - . '.. . .- . and bath limit usable space on both floors. The house and roof exists at 3.6'from the left property line. The proposed dormer does not extend beyond the current condition. 2. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: a)The proposed new master addition is relatively small and along the back left side of the existing house for limited view from Elm St. The aesthetic of the addition stays within the style of the existing house b)The modified front porch remedies the encroachment of the existing roof over the front property line.The new porch roof will have a better aesthethic,thereby bettering the character of the neighborhood. c) The dormer along the left side of the house will not infringe on neighbors'views.The addition fits within the style of the proposed residence renovation and existing character of the neighborhood. Revised 01/2021 ZONING BOARD OF APPEALS APPLICATION FORM PAGE 7 3. Whether the variance is substantial. The requested variance is not substantial for the following reasons: a) The min. front yard setback variance requested is 10'(0'instead of 10'). The pre-existing/non-conforming porch roof extends beyond the front property line by approx.0.8'. The 100%variance is substantial. However,tthe proposed new porch roof removes the existing encroachment situation and remains small in size to limit impacts. b)The min. side setback variance requested is 0.4' (3.6' instead of 4.0'required). The pre-existing/non-conforming residence the 10%variance(4.8")may be viewed as not substantial. c) The total side setback variance requested is 2.3'(9.7'instead of the 12'min. required). The pre-existing/non-conforming residence currently has the same setback condition. As the new dormer and new porch roof do not extend beyond the existing condition,the 19.2%variance may be viewed as not substantial. non-conforming residence did have a coverage of 34.8%with a previous covered roof area along the back. This roof area has been removed to limit coverage. The proposed expanded master suite,when added to the main house coverage, results in only 33.2%coverage. As the overall coverage has actually decreased and the 3,960 sq.ft. lot is 2,640 sq.ft. less than the 6,600 min. lot size required in this area,the 10.7%variance requested may be viewed as not substantial. 4. Whether the variance will have adverse physical or environmental effects on neighborhood or district. The requested variance will not have an adverse physical or environmental effect on the neighborhood or district for the following reasons: The variances requested should not have any adverse physical or environmental effects on the neighborhood or district: a) The modified front porch roof(front yard setback variance)will be smaller than existing and have no further encroachment over the front property line. The front porch roof will drain onto the project site and not shade or limit views from any adjacent properties. b) The new shed dormer proposed for construction along the left side of the house will not extend beyond the existing left house wall and roof; No additional drainage will be diverted along this side of the house. The dormer will not exceed the height of the existing house roof ridge;The new dormer should not shade or limit views from adjacent properties. c) Neither of the side setbacks change or exceed the current conditions.,therefore there is no expected change that would cause any physical or environmental effects. d) The overall 33.2%coverage of the principal building is a reduction from the pre-existing condition of 34.8%. As a reduction, the 10.7%variance should not have any new physical or environmental effects on the neighborhood. The site also is proposed to remain over the 25%min. permeable area for code compliance. 5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance).Explain whether the alleged difficulty was or was not self-created: The alleged difficulty were not self-created: a) The pre-existing/non-conforming front porch roof extended 0.8' beyond the front property line. The request to modify the porch roof to remove the encroachment results in a 100%variance for a functional covered stoop. This difficulty is not sclf created. b) The pre-existing/non-conforming house exists with a min.side yard setback of 3.6'along the left property line. The proposed new dormer,to be functionally located along the existing interior side stairway,will be located directly over the existing left wall of the house. The roof overhang of the dormer will also not exceed the current conditions. This difficulty,as it is not exceeding currcnt conditions, 13 not self created. c) The pre-existing/non-conforming house exists with a 6.3'right side setback,which when added to the existing 3.6'left side setback results in a 9.7'total side setback, 2.3'less than the 12' min. required. There is no proposed change beyond the current condition. This difficulty is not self created. d) The pre-existing/non-conforming house covers 34.8%of the existing small lot. Although the removal of the rear covered storage and the 7'-6"addition to the master suite are self-created,the lot is undersized by 2,640 sq.ft.which is not self-created. Also,the overall 33.2%coverage is an actual reduction in coverage from the previous 34.8%. This is self-created but the modifications result in a reduction of non-compliance.
