B.A non-conforming structure may not be extended or expanded to increase nonconformity unless dimensional relief is granted by an area variance from the ZBA. To grant an area variance,the ZBA must balance the benefits to the applicant and the health,safety,and welfare of the neighborhood and community,taking into consideration the following: I. Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have been explored (alternative designs,attempts to purchase land, etc.)and why they are not feasible. Other designs have been reviewed but extending the existing house footprint along the property line that is with the setback limits provides the best design. An additional setback off that property limits the plan area significantly. The non-conforming side (the garage) is to remain. The existing front porch is non-conforming and a porch extension does not work if not aligned with existing. 2. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: The variance granted will allow the house to grow to the size of the neighboring houses and be a desirable upgrade for the neighborhood and street. The requested variance is not substantial for the following reasons: The variance is not substantial. It is an addition on the side of the house that is within the allowable setbacks. The front porch variance is not substantial as it aligns with the existing porch but grows the porch to a size that more closely matches the neighboring porches. 4. The requested variance will not have an adverse physical or environmental effect on the neighborhood or district for the following reasons: It is an extension on the side of the house that is conforming to the minimum setback. The front porch is aligned with the existing and grows the porch to a size that more closely matches the neighboring porches. 5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance).Explain whether the alleged difficulty was or was not self-created: The difficulty was not self created. City staff will prepare a legal notice for the public hearing and arrange to have the public hearing announcement printed in the legal notice section of a local publication at least 5 days before the hearing.
