As stated in the letter submitted on 5/20 by the Maple Ave, Marion Ave, Maple Dell neighborhood association the application does not justify the formation of a PUD as it fails to meet multiple objectives that are laid out in the zoning ordinance. A more exhaustive list has already been provided in the letter, but to highlight a few: 4. Provide for uses and amenities that fulfill an identifiable com- munity need. Stewarts proposal of a public benefit of sidewalks on a busy road and a 40 ft deeded buffer area are not significant enough public benefits to justify the increased commercial presence along Marion Avenue. 5. Provide for enhanced open space and the preservation of natural resources/6. Prevent soil erosion and enhance the preservation of trees, outstanding natural topographical and ge- ological features. A currently heavily wooded area would be cleared for the ex- pansion of commercial activity. Clearly, this does not enhance open space or preserve natural resources. Since this project is nearby the Loughberry Lake Watershed environmental effects on any expanded development need to be considered by the planning board.
