The Board notes the narrative for the questions posed; however, the Board would like to confirm that there are no proposed changes to the physical proposal presented at a previous meeting. Response 1. Comment noted.There are no changes to the physical proposal presented to the Zoning Board at a previous meeting. Question 2.The Board previously proposed potentially adjusting the lot line. Has there been any further consideration on that matter? Response 2.The Applicant is amenable to adjusting the lot line between their two lots, if so requested by the Zoning Board of Appeals. However, neither lot meets the required minimum lot size requirements of the UR-3 Zone District. Therefore, decreasing the size of the 108 Clinton Street Parcel (which is 4143.71 square feet) will only increase its non-conformance and increasing the 11 Pine Alley parcel which is the subject of this application will not achieve a lot size that conforms to the minimum lot size requirement. Adjusting the lot line will also not alleviate the need for lot width, front yard, rear yard, side yard, and minimum first floor area requirements on the 11 Pine Alley parcel. The applicant, as stated above, is receptive to discussing this possibility with the Zoning Board of Appeals and will adhere to their advice, if so requested. 38 High Rock Avenue,Suite 3 I P.O. Please provide any additional information on this proposal as soon as possible since your project is scheduled to be on the ZBA Agenda for June 07. Response 3.The applicant re-states additional information provided in the amended variance application as follows: A. Utilities (water and sewer) are proposed to be provided by extending such services from Clinton Street through the 108 Clinton Street parcel to 11 Pine Alley.The property at 9 Pine Alley recently has had such services extended to service it from Clinton Street. B. Other existing Pine Alley properties are currently provided emergency fire and ambulance service as well as snow plowing and road maintenance by the City of Saratoga Springs. The paved carriage way is sufficient for such service vehicles to access through the alley. As demonstrated in the amended Variance Application, several fulltime residences exist on Pine Alley and Brackett Lane as do garages/out buildings for parcels on adjacent streets and on-grade parking areas for such parcels. (See Inventory Maps of existing land uses on Pine Alley and Brackett Lane in amended Variance Application). Furthermore, the 11 Pine Alley parcel has been assessed by the City and taxes paid contribute to the provision of such emergency fire, ambulance, and snowplowing/road maintenance.
