Reviewed by the Saratoga County Planning Board on October 20, 2016 and April 21, 2017. Decision: No Significant Countywide or Intercommunity Impacts Comment: Please see our October 24, 2016 referral response letter to Susan Barden (enclosed) made in response to both the submitted area variance and special use permit. A determination was made by the Saratoga County planning board on October 20th of there being No Significant Countywide or Intercommunity Impacts associated with either the area variances or the special use permit. Again we note that the proposed commercial use (drinking and eating establishment) is one permitted in the TRB District. The granted yard setbacks are associated not with the re -use of an existing structure but originate through the introduction of a second floor addition for residential use, one that is permitted by a special use permit. As noted, the yard setbacks presented no countywide impacts and no impacts were expressed from the county perspective due to the parking setbacks (other than the possibility of impeding free flow of internal traffic of patrons). This agency's review of the special use permit suggested that the city review boards may want to consider a discussion of limiting (or not allowing) such outdoor entertainment that may be of a negative impact to the neighborhood character. As part of our review of the site plan, it was suggested that inclusion of proper buffering may be a local consideration. The subject parcel is 0.29 acres in size, which is less than the requirement of a minimum 1 -acre of disturbance under DEC General Permit standards for the formal 50 WEST HIGH STREET (518) 884-4705 PHONE BALLSTON SPA, NY 12020 (518) 884-4780 FAX 1 filing of a Notice of Intent. The City of Saratoga Springs, however, requires any commercial project disturbing more than 0.1 acre to follow the DEC's most current design manual with respect to stormwater quality and quantity controls. This project complies with the General Permit standards, but no NOI is required to be filed. The project's peak discharge rate will be controlled by the proposed improvements for stormwater management and storage, utilizing an underground piping infiltration system that is designed for 100 -yr. storm conditions.
