In accordance with the requirements of the SEQRA Regulations set forth in 6 NYCRR Part 617,the Planning Board adopted an Amended Findings Statement on April 8, 2021; Having properly noticed and conducted public hearings from February 1, 2018 as required and continued through May 6, 2021 on the proposed uses; And,upon evaluation of the application based on the City's enumerated criteria to ensure that the proposed use(s) will not adversely affect surrounding properties and community character; And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7.1 "Special Use Permit",the Planning Board issues the following decision on May 6, 2021 (passed 6-0 in favor: Torpey, Boivin, Horton, Fabozzi, Bonitatibus,Doty): 1. The maximum number of residential units shall not exceed 179 and commercial uses shall not exceed 147,600 square feet. The total square footage of permitted, non-residential land uses is 147,600 sf. The land use categories identified shall not exceed the following limits; a. Office Uses(total) 30,000 sf b. Medical Office 3,500 sf c. Manufacturing 4,000 sf d. Institutional/Educational Use 4,000 sf e. Day Care Facility 6,000 sf f. Financial Institution 3,000 sf g. Artist Studio 3,000 sf h. Training&Educational Services 7,500 sf i. Hotel including Health&Beauty Spa 100,000 sf—including a maximum of 60 rooms j. Accessory Uses 3,000 sf max each 3. The total residential units shall not exceed 179; which includes 9 temporary guest suites. 4. Proposed Definitions: The Special Use Permit proposes three definitions for uses which are not currently defined in the Zoning Ordinance—these uses as defined below: a. Research and Development: A facility where research and development is conducted in industries that include,but are not limited to,biotechnology,pharmaceuticals, medical instrumentation or supplies, communication, and information technology, electronics and instrumentation, and computer hardware and software. A research and development establishment may create prototypes of products,but may not manufacture products for direct sale and distribution from the premises. b. Temporary Guest Suite: An accessory residential unit which is owned and operated solely by a homeowners association, condominium, or cooperative as a limited common element and/or associated benefit of membership within the association, condominium or cooperative and may be occupied by guests of owners therein on a short-term basis not to exceed 30 days. The maximum 30-day stay may be extended upon certain circumstances by consent of the HOA. The unit may not be rented or otherwise leased, let or hired out to third-party occupants under any circumstances not defined herein. c. Community Garden: Fruits, flowers, vegetables, or ornamental plants cultivated by a group of people rather than a single individual or single household. Conditions: 1. All subsequent site plan applications must contain a narrative demonstrating conformance with all thresholds, limitations, and mitigation measures of the Excelsior Park SEQRA Amended Findings Statement(2021). 2. A determination of conformance with the Amended Findings Statement shall be made by the Planning Board and shall be documented on all final plan sets. 3. No increase in building footprint from original 2002 proposal. The maximum building footprint of new development shall not exceed 2.9 acres—for a total of 5.1 acres when accounting for existing buildings on the site. 4. Maximum 8 phases over ten-year period. 5. 60% of total project area(55 acres) shall remain as undeveloped greenspace.
