NOTICE OF DECISION
In the matter of the application
#20210198
AgroChem
26 Freedom Way
Saratoga Springs, NY 12866
Involving the premises with tax parcel no. 177.- 1 -62.212 in the City of Saratoga Springs, on an application for site
plan review for a proposed 16,000 sq. ft. warehouse expansion and associated site work in the Industrial General
(IND-G) district.
In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA short
Environmental Assessment Form Parts I and II, made a motion to issue a Negative SEQRA Declaration on May 6,
2021 .
And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter
240, article 7.2 "Site Plan Review", the Planning Board issues the following decision on May 6, 2021 (passed 6-0
in favor: Torpey, Boivin, Horton, Fabozzi, Bonitatibus, Doty):
Approve with the following conditions:
• The Board grants a waiver to permit the number of parking spaces to exceed 20% over the
minimum requirement for the warehouse use ( 15 additional parking spaces) per 6.2.3.
• Tree protection detail to be included in the final plan set.
• Tree protection measures for the five existing trees along Freedom Way shall be installed prior
to any site work.
• The seven existing trees to be removed shall be replanted or replaced on the site.
• Final plans shall be provided to the satisfaction of the City's designated engineer and DPW.
The applicant is required to:
I . Deliver a letter of credit or cash escrow in the amount approved by DPW to the City per Article 7.2. 15 of
the Zoning Ordinance. This must occur prior to final signature by the Planning Board Chair.
2. Submit one ( I ) mylar and two (2) paper copies of the final approved site plans for signature by the Planning
Board Chair within eighteen ( 18) months of approval as per Article 7.2. 12 of the Zoning Ordinance.
Note: this approval shall expire within eighteen ( 18) months of the signature of final plans if the applicant has not
started actual construction as per Article 7.2. 14 of the Zoning Ordinance.
