Response to comments from Michael Billok/132 Nelson Avenue
We would like to respond to the letter and verbal comments of Michael Billok of 132 Nelson
Avenue regarding the building application for 166 Lincoln Avenue:
1.) Multi -Family Neighborhood: During Mr. Billok's verbal comments at the last planning
meeting, he stated that there are no multi -family dwellings in the area. As we will
demonstrate in our presentation to the planning board this is not accurate. We have
identified at least 12 multi -family dwellings, both official and unofficial, and properties
that include a main house and a cottage within a 1-2 minute walk from Mr. Billok's
property at 132 Nelson, and our property at 166 Lincoln (in some instances, the homes
are directly or nearly across the street from Mr. Billok's house). The properties include:

• 158 Lincoln Avenue - a two-family house;
• 164 Lincoln Avenue - a three-family house;
• 20 Frank Sullivan Place - a single family house operating as an unofficial multi -family
rented out to several Skidmore students throughout the year;
• 150 Lincoln Avenue, Williamsburg Court Apartment complex - this complex houses
several apartments (20+?) and faces four different streets;
• 64 Webster, two-family house;

2.) Visibility Issue: In Mr.Billok's letter to the Zoning Board, he stated his concerns that "A
two-story structure would be visible from my lot". If Mr. Billok plans to move his
residence to the back of his lot, or stand on top of his garage and look into the back of
our lot, this is probably true. We do note believe, however, that the proposed structure,
with a [revised] 25 foot setback and up to 29 feet in height, would have any impact on
Mr. Billok's views since his house is placed far forward on his lot, facing Nelson Avenue.
In fact, to see his house at all, we would have to go to the back or our lot and stand on a
ladder to look over the fence. We believe the concern re: visibility is a
mischaracterization and/or exaggeration of the potential impact upon him.
We also should state that we find his objections rather ironic, since his existing two-
storey garage is entirely within view from our house - from our yard, deck and inside the
house on a daily basis. It does not require going to the back of our lot or standing on a
ladder to see his two storey structured) which is visible from our property at all times.

Mr. Billok is also apparently in the process of adding a large two-storey extension to
his house, which is causing a good deal of construction noise audible from our property
on an almost daily basis. We have not complained or impeded his ability to complete his
project, as we understand this is part of the building process. We would hope he would
be equally understanding of our building needs going forward and not pose further
unreasonable objections.

3.) Noise issue: In Mr. Billok's letter to the Zoning Board, he stated his concerns that any
new structure could be rented to students or track renters. No one knows better than we
do the impact of students on the quality of life in the neighborhood as our street is a
regular thoroughfare for students before and after parties at the houses on 138 Nelson
Ave and 20 Frank Sullivan Place. This is a problem we are constantly managing with the
help of the other homeowners and we have no intention of adding to it by renting to
students, etc.
Response to comments from Rose Tait, 164 Lincoln Avenue
We would like to respond to the letter and verbal comments of Rose Tait of 164 Lincoln
Avenue regarding the building application for 166 Lincoln Avenue:
1.) Zoning objections: For the most part, Ms. Tait's letter only points out the reasons why
we have asked that an exception be granted for this building request, i.e. that the
neighborhood is not officially zoned as a multi -family neighborhood.
2.) Drainage issue: In her verbal comments at the last meeting, she mentioned issues she
has had with drainage on her property and suggested this may be a problem for us as
well if we build another structure. We have never experienced issues with drainage at
our house. In our opinion, Ms. Tait may be experiencing drainage problems because her
house does not appear to have functioning gutters. In addition there is very limited/no
landscaping around or in front of the house. The lot is basically setup as a commercial
parking lot which operates during the summer. Perhaps repairs to gutters and
additional landscaping would help mitigate drainage issues at 164 Lincoln. This issue
has nothing to do with our property at 166 Lincoln.

3.) Context of the complaints/Absentee Landlord: We feel that it's important to
understand the context of the complaints from Ms. Tait. She is an absentee landlord
who hasn't lived on Lincoln Avenue for many years. In fact, the standing she holds as a
property owner in this matter is predicated on the property at 164 Lincoln, which has
now been vacant for nearly a year, and hasn't had full time renters for a few years.
