Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have been explored (alternative designs,attempts to purchase land,etc.)and why they are not feasible. The benefit sought by the applicant is to achieve a new residential building lot for sale so that they may remain in their home as they age To achieve this benefit the applicant has started the subdivision application process with the City of Saratoga Springs Planning Board. The subdivision application was denied 9+/-years ago after much PB discussion about the driveway,traffic and lot shape. The applicant retained a Traffic engineer to determine citing of a driveway along Birch St. could be done to meet safety standards. The lot shape originally proposed was necessary to meet the 6,600 sq.ft. minimum lot area required in the UR-2 zoning district. There is no adjacent land available for purchase to make this proposed lot meet the size reqs Tired Ibdividin0 a nelN lot to the Fact of the evisting residence is not feasible as a new lot in this location would not meet zoning requirements for lot width, would limit parking for the existing residence and would result in the removal of more trees. 2. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: 1)The 620 sq.ft. area of the lot variance was originally proposed as a"jog" in the Eastern property line. The removal of this jog, creating the need for the variance will not actually be viewed by any adjacent properties except for the existing Lot#1 2) The variance requested does not change the main building envelope or proposed location of the future Principal structure. A single family residence of approx. 2,400+ sq.ft. may be easily built on the new Lot#2. A house may be built on the reduced size lot to meet the zoning requirement of 900 sq.ft. min for a 1 story house and 700 sq.ft. 1st floor for a 2 story house. Consistency with the min. house size outlined in the Zoning code reduces the potential impact of the variance on the neighborhood. Revised 01/2021 ZONING BOARD OFAPPEALS APPLICATION FORM PAGE 7 3. Whether the variance is substantial. The requested variance is not substantial for the following reasons: The 6.1%variance requested from the required 6,600 sq.ft. min. lot area is only 404 sq.ft. and is not substantial. An area of 404 sq.ft. is approximately 20'x 20' 3". All other zoning requirements for future development are able to be met. The 6.1%variance requested does not limit future development or require any additional variances for development. 4. Whether the variance will have adverse physical or environmental effects on neighborhood or district. The requested variance will not have an adverse physical or environmental effect on the neighborhood or district for the following reasons: The area variance requested should not have any adverse physical or environmental effects on the neighborhood or district as the 404 sq.ft. area of variance included a portion of land towards the North Eastern portion of the proposed new lot. Removal of that area of land from the proposed new lot does not cause any additional disturbance, no additional trees will be cut due to the variancc and no additional run off may be attributcd to the proposcd variancc. The proposed building envelope for the principal building remains unchanged with or without the variance. Therefore, the actual variance should not result in any impacts. 5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance). Explain whether the alleged difficulty was or was not self-created: The alleged difficulty is not self-created. 1)A new residential lot is able to be created in the proposed location to meet the City of Saratoga Springs zoning standards. However, in the past, the City of Saratoga Springs Planning Board has denied the applicant the right of subdivision due to the substandard lot size so that the lot may be more conforming in shape. 2) The proposed new lot location is limited by the installed"slip ramp" intersection. During discussions with the City for the additional land needed for the intersection, the Owners were not aware that such a decision would limit their future development and subdivision options. We have reviewed the submitted materials in accordance with the New York State Historic Preservation Act of 1980 (section 14.09 of the New York Parks, Recreation and Historic Preservation Law). These comments are those of the Division for Historic Preservation and relate only to Historic/Cultural resources. We note that the proposed project is located within the State and National Register listed West Side Historic District. We understand that the proposed project will include subdivision of the 215 Grand Ave property into two lots, and construction of a new home on the new corner lot. We have no concerns with the proposed property subdivision only, and there are no archaeological concerns associated with this project. In order for our office to continue this review, and fully assess potential impacts to the historic district, please provide elevation drawings of the proposed new construction. The new construction should be compatible with the surrounding historic district in terms of size, scale, massing, fenestration, cladding materials and other visual properties.
