The applicant having applied for an area variances under the Zoning Ordinance of said City to permit the construction of residential addition to the existing house in a Rural Residential (RR) District and public notice having been duly given of a hearing on said application held on the 19th day of April through the 10th day of May, 2021 . In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare of the community, I move that the following area variance for the following amount of relief: TYPE OF REQUIREMENT DISTRICT PROPOSED RELIEF REQUESTED REQUIREMENT MIN SIDE SETBACK 30' 14' 16' (53.3%) as per the submitted plans or lesser dimensions, be approved for the following reasons: 1 . The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant desires to build an addition to their home in order to make room for a first floor bedroom. As per applicant there are several wetland areas on the property, preventing expansion to the north of the property. Expanding the house to the front would necessitate a front setback variance and expansion off the back would absorb a majority of the limited usable yard space. Furthermore, expansion to the other side of the house is not possible due to the steep grade of the property. The Board notes the reduced size and layout of the proposed addition. 2. The applicant has demonstrated that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. The applicant notes that the proposed addition is architecturally consistent with neighboring homes that are similarly situated along the lakeside. 3. The Board notes the requested variance is substantial, however the impact of the substantiality is mitigated by the large distance between dwellings on this property and the neighboring property. Per the applicant, the neighboring property has a house situated well-away from the property line and the view is obstructed by a cluster of mature trees. The Board also notes a favorable letter of support from the neighboring property regarding the requested variance. The Board notes the existing vegetative cover on the east side of to the property providing some buffer to neighboring property. 4. This variance will not have a significant adverse physical or environmental effect on the neighborhood or district. The addition is proposed to be as far away from the wetlands as possible. 5. The alleged difficulty is considered self-created insofar as the applicant desires to build the addition. However, this is not necessarily fatal to the application It is so moved.
