NOTICE OF DECISION

Involving the premises with tax parcel #I 92.-I-I 0 and I 92.-I-39, in the City of Saratoga Springs, on an
application for final subdivision plat review of a I 5-lot conservation subdivision within the Rural Residential
District with the Planning Board who met on February 25, 202 I and made the following decision(s)with a
7-0 vote (In favor: Torpey, Fabozzi, Horton, Boivin, Bonitatibus, Mayo, Doty):
In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified this request as a Type I Action.
C� Issued a Negative SEQRA Declaration on July 30, 2020
C� Issued final subdivision plat approval of a I 5-lot conservation subdivision as per the requirements set forth in
the City of Saratoga Springs Subdivision Regulations with the following conditions:
• City Arborist-approved tree protection detail to be provided with the site details on the final plan set.
• Tree protection measures to be installed and inspected by the City Arborist prior to any site work.
• Revised dimensional standards as provided with maximum building/structure height of 35 ft.
• Existing stone wall to be relocated and reused on the property.
• Final subdivision plat and conservation easement language shall reference the Planning Board's
Conservation Area and No-Cut Buffer Policy.
• The final plat shall delineate the conservation area and provide physical markers and signage denoting
this area and shall be reviewed and approved by the Chair prior to signing of the final plat.
• Conservation easement language for lots I, I I, I 5 shall be to the satisfaction of the City Attorney and
include reciprocal rights of enforcement by all property owners of the provisions of the conservation
easement.
• Conservation easement language shall include rights of enforcement to all lots with the development.
• Conservation easement language shall also include the City of Saratoga Springs and/or a designated land
trust as a third-party enforcer.
• Restrictive covenants shall be provided within the respective deeds for lots I, I I, I 5. Draft deed
language to be provided prior to signing of the final plat by the Chair and shall be to the satisfaction of
the City Attorney.
• The final plat shall include addressing for the new lots per approval by the Department of Public Works.
• Final plans shall be to the satisfaction of the City's Designated Engineer and the Department of Public
Works.
• Conservation easement language shall provide flexibility in the location of a future trail system(on both
parcel I (upland area)and parcel 2(lowland area))and the public parking area(including on City-owned
property at the corner of Crescent Ave.and Kaydeross Ave. East). Optimal location to be determined
in consultation with Open Space Advisory Committee and the City's Sustainability Coordinator.
• In lieu of construction of the proposed trail systems and public parking area the applicant shall provide
cash escrow of funds for future development of such improvements. Amountto be based on the length
of the proposed trail and the size of the parking area.
• The Planning Board recommends that the City Council use the required recreation fee in lieu of
dedication of recreational lands($30,000)toward the construction of a lowland trail on parcel 2 and/or

toward trail stewardship/maintenance.
• Maintenance and insurance responsibilities of the post-construction areas of the trail and public parking
shall be transferred to the City upon approval by DPW and the City Attorney.
The applicant is required to complete the following as per the City of Saratoga Springs Subdivision Regulations:
• Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on-and
off-site improvements.
• Submit a fee in lieu of recreational lands of$2,000 for each new residential lot per Appendix A of the
Subdivision Regulations.
• Submit two (2) mylar and two (2) paper copies of the final approved subdivision plat for signature by
the Planning Board Chair.
• File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as
provided in Article 3, Section 32 of General City Law.
This approval shall expire if not enacted within I 80 days as set forth in the City of Saratoga Springs
Subdivision Regulations Article II, Section I. D.I 5.
