NOTICE OF DECISION
In the matter of the application #20210222
Mackey Auto Group
250 Excelsior Ave.
Saratoga Springs, NY 12866
Involving the premises with tax parcel #I66.-I-5.2, in the City of Saratoga Springs, on an application for
a modification to a previously issued special use permit for office and warehouse uses within the
Transect-5 Neighborhood Center (T-5) District.
In accordance with 6 NYCRR Part 617.5, the Planning Board classified this action as a Type II action and
therefore, exempt from further SEQRA review.
Having properly noticed and conducted a public hearing on April 8, 2021 as required on the proposed
use;
On November 19, 2020 a special use permit was issued for 9,958 sq. ft. within the existing building for
motor vehicle repair (service support facility for auto sales establishment).
This special use permit is a modification to that special use permit to add a combined 1,910 sq. ft. office
and a combined 9,489 sq. ft. storage/warehouse uses within the existing building.
And, upon evaluation of the application based on the City's enumerated criteria to ensure that the
proposed use(s) will not adversely affect surrounding properties and community character;
And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7.I
"Special Use Permit", the Planning Board issues the following decision on April 8, 2021 (passed 7-0-in
favor: Torpey, Boivin, Fabozzi, Bonitatibus, Mayo, Doty, Pipia):
Ei Approve with the following modified conditions:
I. No direct vehicle repair services/customer sales permitted.
2. Hours of operation shall be 7:00am to 6:00pm daily.
3. All servicing of vehicles shall take place within the building.
4. No long-term outdoor vehicle storage permitted on the site.
5. The current SUP issued May 25, 2017 for a brewery and tasting room shall expire with the
implementation of this approval.

Note: this approval shall expire 18 months from the issuance date unless all conditions have been
complied with and actual work begun.
