We purchased our home in December of last year and immediately began a huge renovation, costing us a ton of work, time and money, when we bought the Douse there was a glass enclosed sun room off of the kitchen that extended onto the deck. We decided to remove that room, in favor of having the Kitchen open right onto the deck. When we removed the room, it became clear that the doors that red to the glass enclosure were not sufficient to withstand the rain weather. The first rain after we removed the sunroom soaked our new hardwood floors, causing us to have to replace thee. The most affordable best solution for this problem was to put a screened in porch where the glass enclosure was, adding a roof over the kitchen doors and thus protecting the Douse from the rain and snow. we had hoped to add a screened in porch down the road anyway. We dropped off plans for the new porch in Fate August, but they were misplaced by the building department. My wife and I then sat down with Mike Carlson on September 6th to speak with hire about the plans and about revising the permit to include the screened in porch. After our explanation of the issue and a discussion abet what we wanted to do, he told us that as long as the porch did not exceed the footprint of the gess enclosure, we were good to go. Mike gave us a verbal go ahead as long as he received another copy of the plans, which we gave him the following Monday, September loth. Given our conversation with Mike we believed that we were good to start the project as of that date. As a result, our contractors peeled back the roof and began building the screened in porch in the space where the sunroom existed. We were shocked when a weep later, we were informed by Mike that we would not be allowed to the build the screened in porch because our existing deck was tooclose to the setbacks. we were thea told to 'bring our deck into code" if we wanted to build the screened in area. The deck has been there for 30 years. It's one of the main reasons we bought the house. It was never disclosed to us by the seller's realtor that the deck was not in code. We would like to get this issue resolved as soon as possible to ensure no damage is done to our roof house as fall and winter get under way. It should be noted that we a-re-not looLbg to chae ., the nni-p-bnt of the house or deck from the way it was when we purchased the home. It was never disclosed to us - from the realtor OR from the city during the our original permitting process - that the deck was not in code. We had no idea that building a screened in porch in the exact same footprint as the sunroorn would be an issue. The demolition of the sunroom was approved in the original permit submission, with no mention of a setback issue. Furthermore, there are at least 60' of woods between our house and the neighbor's house. And while we understand now that the deck does not meet the 8' required setback, the screened-in porch DOES meet the required setback. The screened in porch is also less of a structure than the sunroom that was previously there. This work has not been approved and all work on the screen room needs to stop until it is. Any further pork will result in a notice of violation being issued which will cause the plan revision fee to double. I spoke with Susan Barden about the zoning issues with this project and i you want to build this screen porch you have to get a survey. Assuming that- the existing deck does not meet the 12' side yard setback you will need to bring that deck into compliance by either gating a Zoning variance or cutting back the deck so that it fits. Any questions about the Zoning variance process can be directed to Susan Barden at x2 .93. I have already reviewed the pians for the screen porch from Don Davis so once the existing deck is brought into compliance I can give approval to start construction on the screen porch the following day.
