In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA short Environmental Assessment Form Parts I and II, made a motion to issue a Negative SEQRA Declaration on January 30, 2020. And, in accordance with requirements set forth in the City's Subdivision Regulations, the Planning Board issued the following decision: Ei Approve the final subdivision plat with the following conditions: • The public access easement for the sidewalk to be located on private property adjacent to Marvin Alley shall be to the satisfaction of the City Attorney. • Revised tree protection detail shall be included in the final plan set for the existing 36" Maple tree along Cherry St. • A note on the final plan for preservation of the 36" Maple shall be added. • Curbing shall be installed along Marvin Alley and new curbing installed around new driveway along Cherry St. • Final plans shall be to the satisfaction of DPW. • Fee in lieu of dedication of recreation lands for one additional lot shall be provided. The applicant is required to complete the following as per the City of Saratoga Springs Subdivision Regulations: • Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on-and off-site improvements. • Submit a fee in lieu of recreation of $2,000 for each new residential lot per Appendix A of the Subdivision Regulations. • Submit two (2) mylar and two (2) paper copies of the final approved subdivision plat for signature by the Planning Board Chair. • File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as provided in Article 3, Section 32 of General City Law. This approval shall expire if not enacted within 180 days as set forth in the City of Saratoga Springs Subdivision Regulations Article II, Section I. D.15.
