We are the adjacent neighbor of this proposed PUD. We live at 11 Marion Avenue and have owned
our home since January of 1987.
Comment 1:
This PUD should be rejected out of hand. This same or similar discussion has happened several
times over the years and in every case the proposed plan to place commercial businesses in
our residential area has been rejected. The PUD is completely adverse to the Comprehensive
plan and Gateway overlays. The PUD is utterly unnecessary and ONLY benefits the business
interests of Stewart's Corp., not the city's residents. Stewarts knew when they purchased this land
that it was residential and that the Mobil Station and carwash and large metal storage building
were non-conforming to the zoning and comprehensive plan.
Complaint: Stewarts Corporation has used residential and conservation zoned lots for
commercial business by clearcutting them and putting gravel on them
for storage, and parking vehicles including many U-Haul Trucks and vehicles being serviced. (see
included satellite photo overlay from the public domain). It appears that Stewarts has not acted in
good faith to respect the current zoning. These lots must be returned to their legal use and the soil
remediated so that the drinking water of Saratoga Springs residents is protected and in the case of
the conservation lot replanted or resod and allowed to return to its natural state.
Question 1: Why has Stewarts been allowed to keep 2 large non-conforming buildings on
conservation Parkland zoned land adjacent to Loughberry Lake standing when no longer housing
any business that created the non-conforming and "grandfathered" status?
We, as members of the neighborhood petition the board to demand they be torn down
immediately! Additionally, Stewarts Corp. has touted the service station is closing and will
no longer be part of their proposed PUD. If so - tear that down too!
Protect our watershed by having Stewarts Corp. remediate the soil under the service station and
the large metal buildings. It is their responsibility to this community.
Question 2: It appears that the car wash is sitting on the border of the residential lot immediately
to the north with no setback. Was this allowed through a special permit?
