Respected Design Review Commission,
This correspondence is in response to discussions that occurred at the March 3,2021 DRC
meeting.The DRC made comments that the applicant had not submitted adequate proof
addressing query#3,"The applicant shall demonstrate that the structure cannot be adapted for
any other permitted use,whether by the current owner or by a purchaser,which would result in a
reasonable return..."The DRC further noted that since no applications had been submitted to
other City land use boards requesting other uses,the applicant had not pursued the options.
On behalf of the applicants,Engineering America Co.would like to note that the act of making a
submittal to a land use board for review does not,in itself,prove the lack of demonstration that
the structure cannot be used for any other purpose. The first phase of most projects involving
land use planning and development typically involves conducting a review and feasibility study of
the underlying zoning,site conditions (such as topography,lot size,etc.) and NYS Building
Codes. After reviewing the site requirements for any development,the choice is then made as to
whether the project site meets the minimum criteria to pursue review by a land use board. Most
developers will not pursue a project if the site and existing buildings do not meet the criteria
required by the City Zoning and/or NYS Building Codes.
