IN THE MATTER OF THE APPEAL OF

From the determination of the Building Inspector involving the premises at 19 Andrews Street in the City of
Saratoga Springs,New York, being Tax Parcel 165.58-1-5 on the assessment map of said City.
The applicants having applied for an area variance under the Zoning Ordinance of said City to permit the
construction of an addition to an existing residence in a UR-2 District and public notice having been duly given
of a hearing on said application held on February 22 and March 8,2021.
In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare
of the community, I move that the following area variance for the following amount of relief:

Setback:
As per the submitted plans dated 2/1/2021 or lesser dimensions,be approved as per this Board's consideration
of the following factors:
1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant.
Since the prior approval on the east side,the applicant determined that the eaves were not included in the set-
back dimension decreasing the distance from 6' to 5.7'
2. The applicant has demonstrated that granting this variance will not create an undesirable change in the
neighborhood character or detriment to nearby properties. Per the applicant,the east side setback will only
affect the eaves on the garage and the rear addition. No other changes from the previously approved variance
will take place. The previous total side setback had been approved at 60%and due to the eaves will now incur a
total of 61.5%or an additional relief of 1.5%
3. The relief requested is not considered substantial at 1.5%and 3%.
4. The applicant has demonstrated this variance will not have an adverse physical or environmental effect on the
neighborhood.
5. The difficulty may be considered self-created. However,this is not necessarily fatal to the applicant.
It is so moved,March 8,2021.
Note: This is a modification of a previous resolution#20200467.

This variance shall expire 18 months following the filing date of such decision unless the necessary building
permit has been issued and actual construction begun as per 240-8.5.1.
I hereby certify the above to be a full,true and correct copy of a resolution duly adopted by the Zoning Board of
Appeals of the City of Saratoga Springs on the date above mentioned, seven members of the Board being
present.
