Avenue. We have lived in and owned our home for 34 years. Our house and outbuildings are
over 100 years old. We have invested, remodeled and preserved our home and barn to make it
a home that we are very happy in. We planted shrubs and trees to dampen the traffic noise and
allow us to enjoy our back yard in peace. This proposal will seriously and negatively impact the
value of our property and impact our use and enjoyment of our property. The plan also appears
to incorporate our back yard as "green space" without regard for our future plans. The new site
of a car wash, service station, and convenience store places them facing our yard within a short
distance without any buffer. When Marion Avenue was widened several decades ago, the city
took quite a bit of the front lawn for eminent domain. The Stewarts proposal will very likely
necessitate widening the road again and adding sidewalks on our side of the street. That would
leave our front door extremely close to the traffic of the street. Quite a few years ago,
environmental impact studies were conducted relating to a similar proposed change in zoning
on Marion Avenue to Commercial. The results indicated that the city's water supply would be
imperiled with a change to commercial use and the application denied. We, as homeowners,
were assured by The Stewarts Corp and then council member-Tom McTygue that the area
close to the lake would always be green space, and that UR2 would be the most intensive
zoning abutting our property. TRB was allowed for current gas station and car wash as
non-comforming use. With the new proposal, additional foot and vehicle traffic pose increased
danger and possible harm in leaving and entering our driveway. We are opposed to the zoning
change to CI on Marion Avenue. Our property will continue as UR2 - would be extremely
devalued, and would negatively impact our use and enjoyment of our property.
