The applicant having applied for an area variance under the Zoning Ordinance of said City to permit the construction of a two-story accessory structure in the NCU-1 District and public notice having been duly given of a hearing on said application held on the 11th day of January 2021 through the 22nd day of February 2021. In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare of the community, I move that the following area variance for the following amount of relief: TYPE OF REQUIREMENT DISTRICT DIMENSIONAL PROPOSED RELIEF REQUIREMENT REQUESTED MAX ACCESSORY COVERAGE% 10%MAX 13.8% 3.8% OR 3 8% RELIEF As per the submitted plans or lesser dimensions,be approved for the following reasons: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant wants to construct a two-story accessory building with a one-car garage and unfinished space above for storage. The first floor will include a half bath. The applicant noted that the first floor would be most conducive to have the extra bathroom for people to use. 2. The applicant has demonstrated that granting this variance will not create an undesirable change in the neighborhood character or detriment to nearby properties. The applicant notes that the two-story structure will be constructed to conform to the architecture on the property,while minimizing the loss of green space. The board notes that the applicant demonstrated other properties in the neighborhood with comparable accessory coverage percentages. 3. The Board finds that the variance at 38% is substantial; however substantiality of the variance is mitigated by the fact that it does not impact the neighboring properties as noted above. 4. The applicant has demonstrated this variance will not have an adverse physical or environmental effect on the neighborhood. Permeability will meet the district requirement, and the applicant has noted that grading has been changed on the property to mitigate drainage issues noted. 5. The alleged difficulty may be considered self-created insofar as the applicant desires to build a two-story accessory building,but this is not necessarily fatal to the application. Conditions: 1. No cooking facility or range. No overnight stays. No bathing facilities. 2. Removal of existing shed. Adopted by the following vote: AYES: 7 (K. Kaplan, B. Gallagher, T. Gallogly, C. Grey, M. Simpson) NAYE S: 0 Dated: February 22, 2021 This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per 240-8.5.1.
