Ginley Gottman Permanent Special Use Permit Accowts
96-116 Ballston Avenue
Saratoga Springs, NY 12866
Involving the premises with tax parcel #s 178.26-1-39,40,46, in the City of Saratoga Springs, on an
application for a Permanent Special Use Permit for up to 18 multi-family residences within the Transect-
5 Neighborhood Center District.
In accordance with 6 NYCRR Part 617, the Planning Board classifies this action as an Type I action,
assumed lead agency and issued a SEI negative declaration on January 10, 20 19.
Having properly noticed and conducted a public hearing on January 10, 2019, as required, on the
proposed uses;
And, upon evaluation of the application based on the City's enumerated criteria to ensure that the
proposed use(s) will not adversely affect surrounding proper-ties and community character-,
And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7.1
"Special Use Permit", the Planning Board issues the following decision on January 10, 2019 (passed 6-
0-in favor: Tor pey, Totino, Casey, Horton, Bristol, Fabozzi).
2 Approve with the following conditions:
1 . Lot line adjustment application is inferred with current SUP application, will be completed as a
separate action.
2. CDTA bus shelter details shall be finalized prior to site plan review.
3. Buffer shall be provided along northern property boundary, to be Finalized at site plan review.
4. Details related to any proposed use and maintenance of existing alleyway will be finalized at
site plan in consideration with the HOA.
S. Egress point from site shall be narrowed to discourage entrance at Ballston Avenue.

6. Water shall be looped through site, to be reviewed in detail at site plan review.
7. Porches are noted as a required element, details to be finalized at site plan review.
Note: this approval shall expire 18 months from the issuance date unless all conditions have been
complied with and actual work begun.
